What processor is in it, D?

If it's an ARM / NVidia then you're stuffed cos Microsoft totally abandoned you and you're stuck at 8.1

If it's an Intel x64 chip then yes, Windows 10 should work in it.

I think the ARM/NVidia chips were on the original Surface and Surface 2, whereas the Surface Pro and Surface 3 were Intel...?

Edit: the clue is in the Windows edition - if it's "Windows RT" then that's the stuffed / abandoned / should-have-bought-an-ipad version...

Core i7, 8gb, 256ssd, intel HD graphics (dell e7240 ultrabook)

Upgrade to 10 (from 7 pro/64) and it fixed a load of driver issues with the usb3 controller and it boots/runs faster. Definitely worth it in this case.

Have you really ? there's plenty of evidence on the net that it's still running behind your back, if you do actually manage to disable it the Win 10 stops working.

Here's the thing, folks. If you have a legit copy of Windows 7 or 8 then you should take the Windows 10 upgrade during the first year, while you don't have to pay for it.
Security patches for Windows 7 and 8 will come to an end which means that even if you only use your PC for surfing the web and writing the odd letter, you will end up being vulnerable to all of the malevolence that is out the on t'interweb.
Going to Windows 10, if nothing else, will keep your PC safe for a few years more than if you stick on Windows 7 or 8.

As long as you like Microsoft snooping on you, even with the "so-called" privacy options selected Win 10 still talks to Redmond, and a standard install with default settings connects to the following...

I went to upgrade my desktop [keeping the laptop as Win7 'just in case', and it told me it could do the upgrade due to my Nvidia Geforce graphics card not being supported.

I've left it alone since..... I've to keep an old WinXP laptop going because Epson refused to issue a driver for Win7 for my Perfection scanner, so I can't use it on my two newer machines.

I run a hardware firewall, that blocks ALL outbound and inbound connections unless explicitly allowed and it still works fine, not because I'm scared of anyone snooping, just because I'm on a fast connection and get bored of script kiddies getting excited when Nmap tells them so

As I've gotten older tho I've realised no one at Microsoft etc actually care what I do, and I like the fact if my Lightroom has a problem I can get tech support on the phone, and speak to an actual person (try that with gimp)

I work in IT, for a software development company, and I have absolutely zero concerns about Microsoft "spying" on me.

Exactly. No matter who makes your phone, computer or whatever, there is always telemetry and diagnostic "phone home" capabilities built in - it's to make supporting and improving the software better and it categorically is not because Microsoft, Google, Apple, Samsung or whoever are either interested in you, nor are they selling your details to the highest bidder.

Installed on a test disk yesterday. .. installed easily seems to be ok....

Prefer the look of 7, but far better than 8, everything seems to work

It's not paranoia, there will be a reason (probably a few) why Microsoft are offering it for free, either to try and gain market share, to get people off older versions of Windows that they don't want to support, they know older versions have problems that aren't worth fixing etc etc, take your pick but Microsoft have a history of abusing their position in the world of computing.

Upgraded the wife's laptop last night and it looks better at first glance. Can't say I was a big fan of the windows 8 metro thing, the new start menu seems what 8 should have been from the start in my opinion.
