I am a self-employed welder/fabricator and I have never heard of EN1090 so where would that leave me? I had to google it to find out. I never ever tackled jobs like that so never needed to know. I mean if someone was to employ me as an employee I honestly would not have a clue. As a welder what do you need to carry the work out for EN1090? A recognized certificate or just a weld test? Not that I am going to do any structural work would just like to know

The bloke proposing to commission and sell this stuff obviously thinks he's found a wheeze which allows him to evade the regulations. I've got some doubts.

The question is to what extent if any is Kent liable. It's either that as a welding sub-contractor he should refuse to be involved, knowing that this is non-compliant steelwork being sold as such (not scrap or sculpture etc.) and if he does become involved he's in for the high jump if it all goes wrong, or that he's just welded things as instructed and what happens after then is nothing to do with him squire.

There have been some hair-splitting arguments, but if you are skating round regulations, you're bound to rely on that.

If the wheeze does in fact hold water, Kent is clearly out of it.

One set of questions which occurs is what the customers for this stuff are asking (if anything) and being told by the seller. Then there's what Kent's insurance company would make of it. They don't like paying out.

I think £300 spent consulting a lawyer who specialises in industrial work, defends people taking advantage of loopholes and even spots loopholes for his clients, would be an investment.

The safe advice is for Kent to steer clear.

There is always someone who knows about a loophole..........usually its someone wanting something for nothing.

There are no effective police for these standards except, in a roundabout way, the insurance companies.

As has been said in all probabilities no one will ever know unless something goes wrong...............its a bit like drink driving.

regarding the law, letting someone drive your car that has no licence and then pleading ignorance never washes with the law the owner always gets prosecuted and you might also say no one will ever know unless you get stopped which is very true but it does happen

From what I read one off designs are exempt? So if I build one farm shed I can get away with it?!!!! and then build one lean too on to a shed and still be exempt? Or will this go on for another 5 pages?!!

Who needs to comply?
The regulations apply to a wide range of activities involving “series” manufactured items:

• Stockholders and metal processors that modify stock - for example by drilling, painting, bending, electroplating etc.
• Manufacturers of metal components or kits that have a structural use in civil engineering.

By “series”, the regulations mean any activity that an organisation carries out more than once, not just the production of a series of standard items. For example a factory that makes bespoke staircases is in the business of “series” manufacture of staircases and all of them will need to carry a CE mark. If the same factory produces a single platform as a special commission, this will be exempt. However if the factory decides to diversify into platforms and makes more than one, CE marking will be required. The HSQE Department has published a Fact Sheet "CE marking of structural metal - In or Out?" to help organisations to decide whether CE marking applies to them.

But how many companies only make handrails, usually these companies also make the balconies, walkways and staircases that the handrails go on which means they will still have to comply with CE marking?

How can anything that's been forged be certified marked as a material anyhow? All this stuff needs testing in court IMO and to do that isn't going to be easy with so many firms sticking two fingers up at it who are still doing it as they always have

My boss is going through all this at the moment, this regulation came into force on the 1st July this year and he only found out about it then. We make a few things that could be considered structural and a lot of things that aren't. There have been a few jobs that the company has lost due to not being CE certified in just the last couple of months so the boss has decided to go for it. This means that we will all have to be coded (to what level I'm not sure) and the boss wants me to go on the course to become the weld tester so we can CE mark our products that need to be marked.

So my question is, does anyone know what is involved in becoming the CE inspector for whichever company one works for?

We have had customers inform us that ALL their welding wire must be CE marked. We make Stainless and Nickel Alloys. Maybe its possible but I have never seen any Nickel Alloys used in construction. I know of a few Bridges and Swimming Pools that use stainless but Nickel....

The way I understand it is that there is also an onus on the customer who is commissioning a structure to make sure the company they are going to use is CE registered. Otherwise it would not be covered by there own insurance.
