If there was nothing wrong with the trailer I'd love to see how they'd try to prosecute on that.
Never stopped them in the past

Was it upheld by the court?Never stopped them in the past
Was it upheld by the court?
A civil county court ruling is only valid if the judge explains the rule/law under which he makes his judgement. No law, no judgement.
That letter dosnt say you cant tow, therefore if landrover says that the handbook is correct, and it does NOT give any proviso re special vehicles then I have complied with what they have stated surely ?? and the handbook clearly states 3500kg.You will need to contact the manufacturer of the vehicle and ask them what your vehicle Gross Vehicle Weight (GVW) or train weight is. They should also be able to let you know if what is stated in the handbook is correct.
It really does annoy me all this "should not" and "must not" garbage from VOSA/DVLA, if it's against the law then it's a "must not" but if it's legal then it's legal end of argument. They really need to get rid of all this "should not" advice and just stick to the black and white of the law.It says should not as there are some that can still tow without it on the plate.
Where a Must not would stop all vehicles.

Were older vehicles which aren't marked up allowed to tow "back in the day" ? If they were then they should still be allowed to tow today, or are they changing the law and applying it retrospectively ?Hi, Yes I agree, but there a number of vehicles that fall outside the scope of the new regs. Older vehicles which aren't marked up

Same as me with my jeep, just use it and don't take the p*ss and the police will just ignore you as they don't want the hassle trying to work out the paperwork on such an old vehicle. So how do I stand with a 1950 pickup?
The bulkhead plate in my series 3 says:View attachment 112268
just sent this to tag you re above post.It says should not as there are some that can still tow without it on the plate.

Vehicles that pre a date I think in 1980 but cant remember for sure.
you stopped me and I had a discovery with 3500 ton trailer and no weight plate HIS answer was 'well that would be you and me both then' !!! just happens that he had a 300 tdi disco with no weight stamping also !!! after us having a chat about the 300 engine and head gaskets etc etc and ways of getting better startup water flow, he said if there was no markings they would look at the tyres load index, add up the load ratings and as long as the load didnt exceed the tyre ratings on you would go ! if everything was in order.
NO it wasnt, I asked him twice, I know the fact of the plateless trailer scenario, and so checked that fact he definitely said as long as the tyres of the towing vehicle and the trailer covered the weight it was no problem, also the disco has no weights stamped at all. He was well aware of this fact as he also had the same problem and he towed with his. There responce about using the tyre load index was re the TRAILER not the car.
Also btw how can you answer to their response, as you were not there at the time, I have a fair skill of talking and understanding and listening to people, as I have done it for 60years and I believe have learnt a fair amount in that time, that is usually from asking the right questions and usually understanding peoples replies, and then making my own decision if what they are saying makes sense --- In my humble opinion. There responce about using the tyre load index was re the TRAILER not the car.
Next question is; How the hell do you know.
