My point is they can ask questions but you don't have to answer them..

I guess you might be obliged to if the tree was on your land and suddenly it’s not there. If you don’t then they could just hit you with the maximum fine?

It’s a legal thing I guess, now I’m not a lawyer but I’m not sure just staying silent is much of a defence in a case like this? It’s on your land so you are responsible

The tree officer that came out to see me was very helpful and understanding, not at all what I was expecting.
He didn’t insist on the replacements going in the exact same position as long as they were on the same elevation he was happy.
Having never had a TPO tree previously I was expecting the worst, but he made it as simple as possible. Most of the trees along the road are TPO’d but he says not many of the other householders bother to speak to him.

Like listed building preservation orders TPO's are legal entity , the process of registration is often but not always instigated by swivel eyes who can , but have no money or property in the game . Mainly it's local done by the authorities own amenities people to prevent anyone from randomly cutting down environmental friendly & aesthetically pleasing trees .

One case I recall was to do with some TPO'd well known tall trees on a famous bayed seaside hill area suddenly dying .

An experienced council man was suspicious , " Two big healthy trees suddenly dying " , Why ?
He went to check the trees and yes they were well into dying but with no obvious reason .
IIRC ....
As they walked round one of the trees they caught their foot on a sod of turf that came free . On their hands & knees they found a big ring of cut turf around each tree and a bit further down every root in reach had had a couple of inches of the body cut out & removed totally severing the roots . Further investigation brought up that a guy in a high value property that over looked the bay had much of the view blocked by those trees & had protested to all around him as well as applying to cut the trees down a year or so earlier , it was refused due the TPO being in place for numerous years .

Looking from the property the owner denied any knowledge of the attack , but it was fairly obvious that the damaged trees were the same ones the guy wanted to cut to improve his view over the bay & thus raise the saleable value of his property with a fantastic sea view by £30,000 or more .
Again IIRC , he was taken to court by the council and got a swingeing fine , a criminal record and had to bear the cost of some new well sized trees to be put in place along with the cost of removing & disposing of the killed trees .

house builders should be made to buy another plot and replant or plant samplings in my eyes to make a wooded area

they make thousands they should supply a woodland area of the trees in the local area but no proffit is proffit

then by all means put a protection order on that woodland area

by plot of land i mean where 10+ houses can be built not i want my expensive detached 5 houses because i want high proffit on those as some builders will choose to do to avoid the 10 houses buy a plot and plant trees there

so in my eyese that do so well your still buying that land and planting trees so you wont avoid it

Usually such plantings these days are the requirements for planning consents .. that local & visiting morons frequently chop some of them down or kill them off by other means often sees such thoughtful planting schemes wrecked within a few years . Also as trees grow some of the schemes will require the felling & grubbing out of the roots to stop over crowding happening .
I've often wondered how many trees planted in urban areas survive thirty years after planting.

Yes well technically you can stand mute and just take whatever fine the court sees fit. What I'm saying is that you cannot make it go away by refusing to co-operate with the TO which is what UKracer's implying should be so.

We live in a conservation area and have a lot of trees in the back garden, they had been left wild for at least 20 years before we moved here and were really overgrown and some were in poor condition due to this. We contacted the council and they sent an officer down to have a look. We told him we were planning an extension at some point so asked what we could or had to do and he was very helpful. He marked the dead / half dead tree's and told us what else we could take out if we needed. There's a huge bent oak that goes up 10' then heads over next doors back garden with nothing on our side except the trunk (searching for light?) I don't know how it's still standing! He said take it out if you want.

The best bit was his name is Andrew Branch

Obviously you know nothing of the law and you persist with your misconceptions and uninformed incorrect opinions.

Do you know what an inalienable right is??? and the police tell you that you have the right to remain silent and its as viable a defence as anything else as if you say nothing you cannot self incriminate and the police would have to investigate and if they found a cause of death for a tree they then have to prove that you did it and thats the difficult bit, they cannot operate on assumptions and they have to operate on prima facsie evidence to present to a court.

No one was even talking about police so I’m not sure where this came from. As Pete said above when it goes to court you of course don’t have to say anything but if you think that’s going to help the situation then I wouldn’t book you as my lawyer.

JUst because a tree dies it aint my fault. They would need to establish a cause and then prove something. My defence would be I was not aware I was at a tree death.

It depends on whats planted and where. A tree starts out as a sapling and is planted 5 meters from their boundary wall soon grows to insane proportions and causes a myriad of issues, not least falling branches in the wind. Total blocking of light at certain times of the day and probably the worst issue, millions of leaves blown onto decking causing a major slip hazard as they seem to give of a slimy substance. Tree fellers (well two actually) but you get my drift, accept some berk planted the wrong tree but refuse to chop it down as its healthy.

I was starting to get a little worried about what Id started with my original question!

I now wish I'd done more research about trees. I had Granddaughter die last year and I've planted a birch in the garden in her memory, seems like a bad choice.
