Coulda just been my shed roof he was talking about, it's much lower than 2 story houses which it is amongst with flu about 1m highI know the top of the flue has to be so much above the ridge to stop fumes going in the house but it’s not 3m! I’ll dig it out as I looked into all this for my wood burner here.
along with polythene cans or any other crap that needs burning seeing though the councill wont let you take stuff to the tip i got grassed up for having a large bondy in my back field in middle of day no smoke as all dry stuff and no wind .some prat rang the fire brigade and they came along they cant get down my sliproad so one walked down to look . he asked if everything was ok and was it controlled yes . he said no probs best to be safe than sorry. i said yea pity some fool phoned you out for nothing as there could have been an emergency somwhere else where you were realy needed . yep we get them all the timeJust make a better draft woodburner, or force-vent it with a combustion fan.
No law against a woodburner in your shed, just against making lots of smoke.

My flue is about 8 meters away from any house but maybe only 4 meters away from a council garage which has a higher peak than my flue. my flue is about 1meter above the flat shed roof that the woodburner is in.pay special interest to this quote
Does the proposed position of the stove mean that the flue will be within 2.3 metres of the house?
If the flue is less than 2.3 metres from your house the flue height will have to go the full height of the house until it reaches at least 600mmm beyond any point that is within 2.3 metres of the adjacent building.
the above quote also means other peoples houses as well so not advised to be ignorant with it thinking you can get away with it because its away from your house but near others
otherwise its 600mm above your roofs tip
In over 5 years of me wood burning I have not had a complaint from any neighbour, in fact quite a few have given me wood to burn that they wanted rid of. Most upsetting thing for me is that someone reported without talking to me first.We have a great neighbour. Really friendly, helpful - great chap. Sadly he’s also a pyromaniac. He’s always burning stuff. He has a shed at the end of our garden and the roof of the shed is about level with our house. Sometimes we can’t see out of the windows for all the smoke and it stinks. We never want to complain as he’s such a great bloke. Sometimes it causes us a fair amount of stress. Wood burning fumes are nasty. The smell of wood smoke is the smell of poison.

Yes as you say @gaz1 I think the flue would be ok even though the fella told me it should be 3 meters high.as long as your flue is over the required amount you should have been fine

but i think the complaint is not the flue its your burning practices
mine was planning are you sure it was enviro health ive got to ask
for them to come out they have either video evidence or photo evidence of your flue belching smoke out
prooving that your belching out particles is harder as you need to put out something white overnight and allow it to get coated then sent for testing to proove it
the other factors is what your burning
for me its wood i get from building work clean wood same with 2 years stored wood so its dry before i even use it
the other complaint is right to a peaceful life and not having to put up with someone else wood stove smell or fumes this also can bring out enviromental health
youve passed the 5 years install of the stove so thats not a problem new install get some stick for them
have you had anyone new moved into the area ?

As far as I can make out, it will become illegal to burn wood from next month unless it is a certified ready to burn wood which can be bought and can then only be burned in a Hetas approved stove.
