Where I live it would be gone in about 15 minutes...leave anything outside without bolting it to the floor and its gone.

As my mate found out the hard way....even bolted to the floor it'll take a walk (motorbike vanished!).

Every house that still has a metal front gate has them secured to the pins too.

It’s called theft by finding. You’ll have to hand it in to a police station and claim it within 28 days if no one else does.

Option 2. contact the landowner, ask them and if it was me, I’d say yes you can take it if you clear up the other junk as well.

Option 3. Spirit it away in the middle of the night and if you get caught it will look like you’re fly tipping.


Option 2. is the best bet by a long way.

So it is illegal to take anything that is fly tipped in England.

Anyone know what the law is in Scotland?

In a popular fly tipping location of a corner of an industrial estate close to me, two of these steel plates have been dumped. They have been there for about 3 months now.

Would make nice bench tops.

Interesting moral thought there. If you walked along your street and picked up several empty drinks cans that the local kids had dropped you'd be clearing litter so not even the police would accuse you of theft. What if you took them home, dropped them in your forge and made a little alloy ingot from them? Still not really theft is it. What if you'd found 100 tin can's? 1000? How about if it was 10kg of aluminium extrusion offcuts that the local window fitter hadn't picked up off the path when they finished their job and left? That would start feeling slightly borderline to me, But where's the difference?
At what point would this change from civic responsibility into metal theft? Theoretically picking up ANY litter and dropping it in a bin would be "permanently depriving the owner of it", So where's the line (And can you reach over it far enough to nab 300KG of plate steel? ).

Ive started an operation like this there are over 100ft of handrailing tube been dumped in a stream near me ive beenfishing a length out a night when out for excercise if anyone asks im combining weights with cardio

(There was a piece of road plate sat at the side of the road not far from me for about a yr. Finally decided I was having it. So me and matey went to get it. It was in the back of the van in double quick time.... once home it took us 10mins to get it out the van. 2.4x1.2m 16mm thick steel weighs over 400lbs. )

There is no obvious legislation I can find in Scotland regarding removing fly tipped waste, apart from the obvious tipping/theft rules.

I assume the owner could object, if they see you, but I doubt it. There is a local field access lane near me that is bad for fly tipping. The farmer has seen me collect stuff, and never said a word. There again, he could see that I was obviously removing things.

Maybe cover yourself in case someone reports you. Take a picture of the ‘rubbish’ on site, then if you get stopped, you can show you were doing your civic duty by removing rubbish.

With all this talk about people salvaging abandoned metal I'm thinking I should look into the possibility of claiming that load of lead our local church has had just laying all around on their roof for years now........ That stuffs toxic you know !

Not sure on that but there is Theft by finding, not sure if this is now superseded by another name.

I underestimated the size, 414kg is not going to be easy for me to move, especially during lock down.

It is probably council owned land so calling them for permission would be a non starter.

in practice because the street belongs to the queen then it can be classed as same with if its on an estate it belongs to the owner if its being fly tipped there

so if the police wanted to be funny you could be charged with theft from the queen

its theft from the estate owner

even if you are helping to clear some of whats been dumped there for your second usage in recycling

however when im asked

i clearly state its been fly tipped here its been here so long now and im clearing some of it up to recycle it helping the enviroment

I appreciate you think you're arguing with me but if fact you are arguing with a point of law. What if instead of tin cans, it was coins dropped by the parking machine? What if I parked my van there and someone though "ooh that scrapper has obviously been dumped"? What if it's a giant sheet of road plate probably dumped by <insert racist comment here> who couldn't shift it on?

It is a grey area but the bottom line is, if you don't own something, it's not yours.

Personally I'd ask the landowner/estate agent out of politeness and just to cover my ****.
