If you had a plate that size, and it was stolen, you could report it to the police and get a crime number.
If you were to subsequently discover said missing plate which had been dumped somewhere, then you would be fully within your rights to recover said plate.

My uncle found a Raliegh Chopper when I was a kid. He handed into the Police who kept it for 3mths. No one claimed it so it was his, or rather mine.

These days the coppers don't want to store the item. So recover the goods and inform them you have it, if after xyz days no one has claimed its yours.

Best tell that to the journalists who do this regularly then, at celebs gaffs. Couple of them were taken to court. You can guess the rest. The Judge said that if it was put outside in a bin for disposal then it was clear that the person no longer wanted it and it was to be disposed of, they were not "depriving " anyone of anything. I refer you back to your original statement.

The fact is, their lost property rooms are stuffed and they just do not have the space. In today's "disposable society" things are disposed of that I wouldn't dream of slinging out. TYA seems to bring quite a bit of stuff back to life nobody wants and give it a new lease. It's shocking really.

Celebrities and journalists are a law unto themselves but in the specific case where the bin is no longer on the owners property it is no longer their property. You did not specify that the bin in question had to off the owners property, that is something I have already addressed here. Responsibility for its disposal rests with the local council, they effectively assume ownership.

Come to think of it, I actually do store items in a bin (on my property) and if I caught anyone nicking it, they'd be for it.

Case law as below

R (on the application of Ricketts) v Basildon Magistrates' Court 2010 Taking bags left outside for a charity shop or from its bins for personal use etc. is theft


R was seen on CCTV taking bags, left for the use of a charity, from outside the charity shop and putting them into his car. The police stopped and searched the vehicle and the bags along with a suitcase containing clothing were found. In a second incident, R had taken items from a bin at the rear of a different charity shop.

He was arrested and interviewed, he admitted that he had taken the clothes to sell on. He was charged with two offences of theft.

At his committal hearing before magistrates, R argued that the property did not 'belong' to either of the shops, and that the offence of theft could not be proved. The prosecution could not prove that the property "belonged to another", for the purposes of section (1) of the Theft Act 1968, as it had been abandoned.

The magistrates did not accept the argument and committed R to Crown Court. He applied for a judicial review on the basis of the argument he had put forward to the magistrates.

In relation to the first charge, the magistrates were able to determine that unknown individuals had left the clothes in order to make a donation to the charity. How the charity shop may have decided to deal with the donation was not relevant. Had they been left where they were, they would have come into the 'possession and control' of the charity. The magistrates were able to infer that the items had not been abandoned, the donor had intended to give the items to the charity, but had been unable to complete their delivery. The donation would be complete when the shop collected the items from outside, but, until then, the donor had not abandoned possession. There was the evidence to conclude that the property 'belonged to another' when it was taken by R.

In relation to the second charge, the charity shop had taken possession of the items and then placed them for disposal in the bins that were within its control. The property belonged to the shop when R took them.

The logic, in relation to the second charge, applies to anyone removing property from a wheelie bin/skip etc. The householder (or whoever) retains possession and control of the contents pending the arrival of the council refuse collectors (or skip hire company etc.) to remove them. At that point, except in very unusual circumstances, ownership would pass to the agency collecting the items.

I got away with rocking up at a Dutch motorcycle jumble on the setup day, the best day to grab something rare, wearing a yellow vest, pushing a trolley with a cardboard box on it and carrying a clip board, free entry on a day with no public access, and free beer and grub, they look after stall holders over there!
