I find it funny that people will pay mad money for ex mod landies...yet would never consider an ex hire car / ex cop car...even at a massively reduced price...

disco commercial or defender has no rear seats at all you would have to pull up the van floor to modify it for rear seats

There is a firm that can fit rear seats and seat belts and still conform to commercial standards so i still get cheap tax

I used to work with 2 reme warrant officers and thay explained that all vehicles weather out on patrol or not were serviced regardless. Meaning landrovers that were parked up and never used were serviced even though they didnt need it

they used to make a range rover van for purchase tax reasons and still do

you might want to read this if back seats are in it's not classed as a van under HMRC

The 13 August ICAS tax podcast highlighted a recent First Tier Tax Tribunal case that turned on the classification of a Land Rover Discovery as a car rather than a van.

Jones v Revenue & Customs [2012] UKFTT 265 was an appeal brought by a mobile technician working for Jaguar Land Rover who was supplied with a new Land Rover Discovery 4 2.7 TDV6 GS Auto for work purposes.

Despite the vehicle being modified to carry engine components and tools as a mobile workshop, HMRC determined that it was a car available for his private use. Jones was hit with an assessment for roughly £2,600 in income tax.

The rear seats and seat belt fittings were still in, but tool boxes fixed above the seats made them unusable. HMRC argued the vehicle should be treated as a car as the modifications were not permanent, nor substantial enough to have altered its original manufactured construction.

Section 115 of the Income Tax (Earnings and Pensions) Act 2003, states a car “is not a goods vehicle”, whilst a van “a vehicle of a construction primarily suited for the conveyance of goods or burden of any description”.

Has anyone encountered a similar situation, or will it change your approach to 4x4s of this type?

If a disco commercial with rear seats is a car, then so is a transit witha second row of seats...

How I read it, it wasn't a commercial, it was a ordinary Disco modded to become a mobile tool box, but the seats were the original factory fit, therefore it in the eyes of the income tax it was still able to be used as a car. A van with a second row of seats starts out as a commercial vehicle.

I think that's because they're 4WD

The difference is a Disco has 5 or 7 seats & Windows all round & is effectively an estate car, this one still had the seats in, if the Disco had been the van version without windows it would have been taxed as a commercial vehicle. The Transit starts out as a commercial vehicle & remains as one even with another row of seats.

But that's what started this off, getting a disco commercial and then retrofitting rear seats.

The other way around came after, along the lines of "watch out because"...

Point taken, my understanding of it for what it's worth, if it's a commercial, registered as that & you put seats in, it will remain a commercial vehicle. If you were to put windows in, I'm not sure. But who is going to check! It's still registered as a commercial vehicle & to get them to change anything is damn near impossible

I wouldnt be putting seats out of a standard disco in, there is a company that fit folding seats that fold just behind the front seats thus retaining it commercial status
