Being fined by DVLA for not taxing a car I no longer own!

Purchase a hpi check to see when the last v5 was issued.

This can tell you if it ever got changed or not.

If it hasn't then could be a giggle.
If ebayer bought through auction/buy it now. Then maybe left feedback and can trace.

If classified add then might not have details.

All, thanks for the suggestions. As I said earlier, this sale pre-date the on line option. I note the comment about taking copies, never done that before, less need now with on-line as the results are obvious and much quicker.

Fortunately my son found a text message thread he had with the buyer when he sold it and the buyer still had the same number! The buyer will contact DVLA on Monday and I now have the name and address of the buyer, which I will send "Signed For" to DVLA. We'll see if DVLA will stop pestering me now!

as youve just found out with ebay

theres no digital footprint to say that youve sold it or bought it on there its also same with other channels

dvla changed the onus on whos responsible in informing them nowadays its both the seller and buyer to inform them that the vehicle has been bought or sold

It used to be that the DHSS , Child Benefit mob & War Pensions sent all incoming mail to a few central point for it to be sliced open & sat open end up in deep open topped trays then sent to the supposedly correct destination for clerks to play with .. I seem to think group 4 was involved .
I lost dozens of sent recorded letters because of it. All the post office could say was the mail was delivered in bulk and only signed for by one person for each bulk delivery . All sorted in the end ,almost five years after my lad turned 18 .. I got a big back payment for my war disablement pension & a decent compensation from the now defunct CB agency

Every time I get an email message from eBay I read it ,then move it to a set up email file , they never get removed or binned . When I get a new computer they are transferred to a stand alone 500 gig memory store as well as getting copied to our , "One drive cloud ".

you will find its still the same now

the onus with there post is its been sent to you therefore you have recieved it

the other way around is proove that you have sent it as we havent recieved it therefore you havent sent it

as for finding out how many has been lost dvla will never tell you

I had some fun about a year/18 months ago where I had px’ed a car to a main dealer and watched them do the transfer online ….

Then got several letters demanding money with menaces from a couple of councils …. Demanding I provide evidence … bill of sale and the like etc…, was fun telling them that just because DVLA has my details doesn’t make me the owner, keeper or driver, and I couldn’t give them any further information because of data protection laws, and as they were not the police I was under no obligation to provide anything and they needed to contact DVLA for that kind of thing.

Has anyone else got caught in this unbreakable loop?

Over 2.5 years ago my son had a car that needed an MoT to make it more saleable. At the time it was cheaper for me to insure it, so we transferred the car to my name, I taxed it for 1 month, insured it, got it insured then SORNd it.

2 years ago my son put it on eBay and it was sold. The DVLA paperwork was completed and sent off. If there was a receipt, my son doesn't have it/can't find it. The details on eBay are long gone.

It looks like DVLA didn't get the paperwork. Since February 2022 I have been receiving letters telling me the vehicle is about to run out of tax. Today I received a letter telling me that I am now to be fined as the tax has run out!

I spoke to DVLA in February and was told to send a letter in. I did. They have a 4-6 week processing delay and so far they haven't found it.

I have appealed but they want the name and address of the new owner which I do not have, neither do I have any part of the V5, so I cannot make any changes on line.

I am being fined for not taxing a vehicle I do not own, but cannot prove I do not own and the DVLA delays mean if the appeal is unsuccessful the fine will double and I assume the "unpaid tax" will continue as long as the new owner doesn't tax it!

Suggestions how to break this cycle?

My son got caught on this, car was sold to a dealer who processed the paperwork & sent it all off. A year or so later DVLA sent a fine through the post saying it wasn’t taxed. It must have been taxed in the meantime by the new owner, but DVLA said they had never received the paperwork. When my son spoke to them, the person virtually admitted the paperwork had been lost at their end, but he still had to pay the fine. It seems they fine whoever they like with little or no comeback.

They took me to court 3 times for no tax. As it was in bits in my unit it had been SORNd.

The magistrates tried to fine me but I explained I even had photographs of the new owner on his trailer with the mini and what was reason for persistent chasing me when it was clear it had not been used on the road and did not even require tax as it was a classic.

I said I would be prepared to go to prison and they would need to pay for me in prison and a carer for my wife.
The DvLA decided to drop the case.

You're now a marked man , you wicked boy , every PCN & town street camera will record your movements & the speed at which you are doing them . Big Bro is watching you !

Further to the SORN & it being off the road , I understand that nowadays ( since two years ago ? ) you must send in an annual SORN if the bits with registered identifier marks such as the engine , chassis ( &/or number plate ?) are still owned by you .
You also have to apply for the licence and then claim the exemption somewhere in the application or it might just be a case of the computer making the decision that it has now become a classic. and there for now issue the now recorded vehicle owner a licence free of charge but you must register it annually so they know where it is so they can send you any traffic enforcement notices /fines or can find your correct address in an emergency situation .

As to doing it annually that should give them and all other government agencies your latest details of address & other contact cross referenceable details .

I guess it helps stop / catch out people cheating the state and costing you & me the taxpayer many hundreds of pounds a year ..though it often does not feel like it as the DVLA FOI's often say 1 in 20 cars ( IIRC ?? ) are not taxed or licensed to be on the roads . It also seems that 6.5 % of all vehicles thought to be on the road are uninsured .

Maybe someone with a better head for where to get more accurate figures will pop up and give a more accurate review.

Your way over complicating this.

Simply make a name and address up. And say you sold it to them.
Fill in the details. On the sheet. You won't hear from them again

I have a special projects IT pal who does the programming end for various types of data recording , cross referencing and matching up for certain government departments. When I told him of events mentioned below he said such incorrect data matches are quite common but advised me not to retain anything not legally mine but to record I'd sent it back & have pictures if possible as it might be traceable back to me & cause problems in the future .

You cannot even guarantee that the DVLA data entry is correct . I got a replacement driving licence sent to me a couple of years ago that was for someone with an entirely different name and date of birth , complete with their photograph & different driving classes on the licence but the address & post code on the card was mine .

I sent it back to the DVLA cut up into in four pieces via recorded delivery with a covering letter ( photo's , copied and stored away ) Not so much of a thank you notification back .

I didn't say use a real address I said make one up. Literally an address that doesn't exist.

Just to add to the posts on this. I did an online check (GOV.UK site) of a car near me I suspected might be dumped (comes back as taxed and mot'ed) but I did notice the following info on that page. See image. This may have helped Pete.
