hi,could anyone tell me if the trailer I built in 2008/9 to carry my scooter on the back of my motor home is still legal and can itake it on holiday to france and spain, it is well built with indispension units and complies fully with eu lighting regulations.etc.it,s just I am getting confused with all the legal jargon and need an answer in laymans terms,iwould beer greatfull for any help or advice. regards.

If it was legal then it will be legal now, regulations aren't applied retrospectively.

I'd make sure your insurance is OK though, some companies are a bit sniffy about homemade trailers.

Going to France the make sure you have a breathalyser kit. In France every motorist must carry their own. They can be purchased on the ferry for about £2.50, saves a 100 euro fine if you are stopped for any reason and the check.

That's not correct;

Breathalysers
1 March 2012 - the French government confirmed that from 1 July 2012 drivers of all motor vehicles and motorcycles (excluding mopeds) must carry a breathalyser. The regulation will be enforced from 1 November 2012 and anyone stopped after that date who fails to produce a breathalyser when requested will receive an on the spot fine of €11.

October 2012 - the French government announced that the implementation of the sanction for drivers not carrying a breathalyser – a fine of €11 – has been postponed from 1 November 2012 to 1 March 2013.

January 2013 - the French government announced that the implementation of the sanction for drivers not carrying a breathalyser – a fine of €11 – has been postponed indefinitely.

So theoretically you are still required to carry a self-test breathalyser when driving in France but there is no current legislation demanding a fine for non-compliance.

The original official announcement stated that one unused, certified breathalyser must be produced showing the French certification mark NF. Carrying two single-use breathalysers will ensure that if one is used or damaged, you will still have a spare to produce. The breathalyser produced has to be in date - single-use breathalysers normally have a validity of twelve months.

was it tested when you built it? If not then its not technically legal, if it was and passed then it is fine

hi, I was given to understand that if it was built before 2010 then it is exempt from requiring a test but it must still conform to the required regs on lighting etc and be in a roadworthy condition,but how you would prove the build data 8 years down the line I don,t know! that's my problem so many conflicting opinions,and legal jagon that I am confused about the whole thing,o for the day,s before the bloody e.u. started poking their noses into our buisines.sorry for the rant!!!.

Stopped on entering France for having "illegal substances"
Namely a bar of soap and can of deodorant!
