In our eyes you are right, the problem is the new owner has the title deed and proof of purchase. The only way I can see the original owner getting compensated is through the solicitors slush fund or their indemnity insurance. Its not looking good.

I get that Bob but the 'proof of purchase' is just proof of a crime comitted. The guy hasn't bought the house, he's paid money for a house he thought was being sold. The fact that he's (apparently) innocent is just hard luck for him.

A chap from the Asian community in Southall was the biggest criminal supplying anything fake. Even the police weren't certain but his fakery has orchestrated many millions of fraudulent activity

Well exactly. The buyer SHOULD feel aggrieved and if he's got a mortgage he should be straight on to the mortgage company because they have loaned money against a property that is not legally sold. What are they going to do if he doesn't make payments? He's been a victim of crime so there's no reason why he should do. I would say not. Theft is 'taking with the intention to permanently deprive'. The fraudster didn't take anything, he just obtained monies by deception.

Hi, From what I understand a claim can be made under the victim support scheme. Which is based a an impact statement the police should take during its investigations. It won't cover all the damages and loss. It's decided at the court case and is paid by the dirtbag accused to the court either in a one off payment or by instalments. It's down to the court to collect and forward the payments to the claimant.

If I buy a car with a V5 but it still has finance on it it doesn't belong to me but if I buy a fraudulently obtained house it's mine ? There's something wrong with that logic.

He's permanently deprived the owner of his house and obtained money by deception plus defrauded the chap who bought it. It happened to a house over the road from us, builders moved in and gutted it, woman came back and contested it then the builders put new doors and windows in and it has now been stood empty for about 8 years and no-one knows what has happened.

No he hasn't, or at least I don't think so. He had no intention of taking the house or depriving the owner of it - no interest in it at all in fact - all he wanted was to get the value of it from someone by deception.

Registering a lease hold property that was not registered back in 1981.
It had previously been registered as freehold by the company who purchased it when built.

Numerous calls to Land registry have resulted in 3 times being told I need to fill in form FR1 and the other 3 say form AP1.

Can you imagine how long this would take to sort out! New owner would be - really out of pocket & not wanting to play. His solicitor would be stalling forever.

There would be two solictors firms involved - the vendor and the purchaser.

Bear in mind that a solicitor(s) are not compulsary. It is possible to handle conveyancing without any legal qualifications whatsoever, so there may not be a bent solicitor at all.
