I ordered a new seal and spline grease for the job last Wednesday from John Craddock. They haven’t even dispatched them yet, and, obviously, no longer required. We had to do the job as the old box was getting really bad.
You are entitled to cancel an order before despatch, unless it has been customised to your requirements with modifications that make it unsellable to others. You can also return any item by notifying the seller within 14 days of your intention to do so and delivering it back to them inside 30 days. You are also entitled to refuse the delivery. If there is nothing wrong with the goods, you carry the return postage costs, so better to refuse the delivery.
I’ve tried to cancel the order before dispatch. I guess they’ll claim one or both items were special order, but I don’t remember seeing any mention of lead times. That’s fine, if they arrive I’ll send them straight back and don’t mind paying return postage.
‘Special order items non-returnable’ and ‘15% restocking fee’ in the returns policy are two things that might cause problems, as I don’t think they’re legally valid, are they?
I’ll see what they have to say.
Both clauses are illegal under CRA2015. Special order items if you are made aware of it or not, are still subject to the same rules.
