I ordered a new seal and spline grease for the job last Wednesday from John Craddock. They haven’t even dispatched them yet, and, obviously, no longer required. We had to do the job as the old box was getting really bad.

You are entitled to cancel an order before despatch, unless it has been customised to your requirements with modifications that make it unsellable to others. You can also return any item by notifying the seller within 14 days of your intention to do so and delivering it back to them inside 30 days. You are also entitled to refuse the delivery. If there is nothing wrong with the goods, you carry the return postage costs, so better to refuse the delivery.

I’ve tried to cancel the order before dispatch. I guess they’ll claim one or both items were special order, but I don’t remember seeing any mention of lead times. That’s fine, if they arrive I’ll send them straight back and don’t mind paying return postage.

‘Special order items non-returnable’ and ‘15% restocking fee’ in the returns policy are two things that might cause problems, as I don’t think they’re legally valid, are they?

I’ll see what they have to say.

Both clauses are illegal under CRA2015. Special order items if you are made aware of it or not, are still subject to the same rules.

First mistake might have been using Craddocks! I use AF for most modern land rover stuff now - pretty helpful bunch and stuff nearly always arrives the next day. Britcar and LRDirect for defender stuff.

I use rimmers , though I always ring and speak to a human before ordering online - they prefer the online ordering thing for some reason ?

They just seem so expensive to me and it's never entirely clear who the manufacturer of the part is. They are normally good though.

Another related, equally boring situation, probably not worth its own thread:

I ordered a silencer for my John Deere tractor from Agriline last Thursday lunchtime. Not a huge thing, maybe 6-7kg, no more than 300mm in any dimension.

Delivery was not cheap - about £22 for a Parcelforce 2-day service, obviously long overdue.

So, realising that my contract is the with the seller, can I claim back all or some of the delivery fee, given the service was not as advertised? I know it’s not the end of the world, and these are small amounts, but this is happening more and more, and I think we need to start asserting ourselves a bit.

Certainly, the service provided was not as described.

They can charge as they see fit, of course, but if advertising a 2-day service…

Ive had delivery issues with Agri line in the past. Paid for 2 day….never showed….rang up after 4 days….another parcel was dispatched and arrived overnight

I’ve not had a problem with them in ten years, so I’d like to let this one little cock-up slide, except for the succession of apologetic but gormless people I’ve just dealt with. Last one was a woman in Sales, who couldn’t tell me where it was or even if it had left the warehouse, but would look into it.

That was 3pm, and I see it’s now 5.50 and she must have gone home without bothering to call me back. She was the third person I’ve contacted today without follow-up.
