Pruning a tree in neighbours garden

Anyone know the rules surrounding this?

This tree is in my mother’s garden, obviously overhangs the neighbours. She comes home to see a tree surgeon pruning their side, no polite word to her in advance. They don’t get on well, but its mainly due to this sort of thing!

Totally fine up here and if they don't get on then you can't really blame them for not saying anything.

My sisters neighbour has a big tree that totally overshadowed her garden in the late afternoons. We crept out commando style and lopped branches off a few at a time over a week or two, so now it looks like it has been on a crash diet.

so definitely they shouldn’t be up there without asking?

Just wish they would talk, even if you don’t get on it’s still polite - Mum had the roof done and just put a polite note through the door saying let her know if there is anything they’re unhappy with.

id say wrong on the last part

due to health and safety they can as long as they dont damage the tree

its the same rules for access to repair your own property however access is granted by climbing a ladder to the tree

not access onto your property through your property to maintain there own property

She’d have done it and paid for it if she has any idea they were unhappy. An English oak providing shade in your garden, most folks would like it

no offense here but

have you offered to clean up the leaves every year and get rid of your rubbish from the tree

if not why not and i bet that you havent even offered to do it or pay for it done

yet quick to moan about it when something gets done about it

its ok for those that want to grow these things things but when it comes to clean up people tend to say its your problem not mine even though its your tree not theres

its the same for hedges and conifers used as a boundary wall they want to grow them for privacy but they dont want to maintain them

that comes from the old theft of apples and pears from a tree

where it has to be returned or you faced jail in old times

shouldnt really exist nowadays as most just cut it down and get rid

however i would like to say this

its 280-300 for a large skip nowadays why should next door have to pay for a skip for others rubbish

its there property that they havent maintained properly by law they should be able to return there property back onto there land for the owner to get rid of

this includes leaves
branches

as its crossed over the boundary onto your property

but instead of that you can be arrested for dumping rubbish onto there land or at worst be arrested

yes but in reality who wants a load of twigs, same goes for windfall fruit it should be offered back

As has been mentioned they can cut back to the boundary but no further, and the work should be in compliance with BS3991. Any timber that is cut has to be offered to the owner of the tree, but you can decline it. If it is taken away without being offered to you I believe it counts as theft but not 100% on that. As to accessing the tree I can't remember the rules governing that, I always avoided contentious jobs like that as they weren't worth the hassle

Just about to post the same link - seems to all be above board. Meanwhile her party chimney is leaking and she’s scared to have the work done in case it upsets them.

These days your house insurance usuaaly asks if you have trees over a certain height within a short distance of your house.......what happens if there is such a tree but its next door.
