You'd have to set a cookie for non cookie use, I believe that this is acceptable as it is a do not track cookie.
The law is around personally identifiable information, which you wouldn't have in that cookie.

Browsers won't reject cookies, unless explicitly set by the user.
If you explicitly set your browser to not accept cookies then you have to expect annoyances. I would imagine the number that do is so small as to be not worth worrying about, as most online activity would be very difficult. I.e. no online banking, minimal online shopping.Which is what Malcolm is referring to. Anyone who has disabled cookies will get the nag message. Their preference could be stored in the db if they're a registered user, but it'd still need some tweaking to add the additional code, if status is purely cookie based currently.
