For example, let's say a 'wheelie bin cleaner' has his pressure jet hose trailing across the pavement, if someone walking by were to trip/have a nasty accident because of it, is he going to jail because of it, even if he didn't take out the required liability insurance before hand??
I dunno, thought that our prisons are pretty much full to capacity nowadays.
I used to work with a guy in the US who was a pilot in his spare time, had couple of small planes for personal use. He told me how someone had stolen one of his Cessnas a few years earlier. The guy broke into the hanger, using a truck to smash the doors open. Then he took off with the plane, ended up crashing, and then successfully sued the guy who owned the plane. Lots of compensation involved.Some time ago my employer sent me on a NEBOSH safety training course; I think it was 4 or 5 full days spaced over 3 months.
One of the subjects that was discussed was what happens in the courts, so the tutor would tell us stories of H&S gone-wrong incidents and then ask us to decide what the court decided (who, if anyone was to blame). I'm sure he had picked his examples to shock us... and he did!!!!
Common sense and the Law are complete strangers; the Law is an ass. Lesson; do everything you can to avoid courts, especially wrt H&S.
