My dads neighbours are building an extension. Theyve asked if they can take the fence down for access for pointing. When the building control officer visited the site he said the footings would need to go deeper duse to clay soil and proximity of trees, so it would be safer if they also took the posts down as they would be unsupported on one side. My brother took my dad through doing a party wall agreement for the fence stating that they could have acess as required and remove the fence if it was remediated to the same standard. He seemed ok with this till the work started. Then started kicking off (to us) that the fence didnt need to come down, it wasn't coming down, they werent putting scaffolding up, we’d swindled him into signing the letter they werent coming on his side etc etc. I pointed out to him that if “he” wanted an extension and the grumpy old sod next door didnt want to allow acess for building he wouldnt be happy, and also if he didnt allow reasonable access he could be prosecuted. The ironic thing is after all this fuss they got the footings in without touching the posts. Old people with nothing better to do than gripe about what other people are doing are a real nuisance
