Ha another claim ------never thought about that-------- coz you have to throw snowballs when its snowing at work------- its the law.

Just to add, he has had carpel tunnel syndrome for 11 years and never told the company he works for despite having a comprehensive medical check up every year, paid for the company. My research has also highlighted that he runs a sideline on weekends being a handyman and regularly uses his own power tools more in one weekend than he does in a whole six months at work. He his rides his motor bike too and from work. Both these extra curricular activities regularly impart significant vibration and likely to aggravate his existing CTS. And of course he hasn't told anyone about these.

I cant for a second see how this is gong to be a successful claim

Which motorbike it is has a huge impact on how much vibration is transmitted to the hands, so tbh that shouldn't even be considered - unless you can get the numbers from the manufacturer...

I don't know which bike it is but I believe its common that most bikes will impart some degree of vibration. I don't have any personal experience as I have never been on a bike.

The situation here is that his frequency of tool usage in his normal day job is exceptionally low yet the duration is huge, hence my question in the first place. With such low usage over two years it is not expected that he will experience any health issues. The situation hasn't been helped by the fact that he has been less than accurate when detailing how long they have been used for. For example many of you will do more grinding in a day with greater risk, but unless you are doing it day in day out there is recovery time involved which slows down the on set of any symptoms. Ive just looked at a case where two chaps were using grinders every day, it took them 17 years before they developed any symptoms

When making such claims it is imperative that all external factors are taken into consideration. so knowing that he is a very light tool user at work and he has exaggerated his timings, and the fact that he hasn't told anyone about additional circumstances which may be contributory factors, (private work and motor bikes) his claim is beginning to look quite stupid.

In fact I would go as far as calling him a liar but professionally I cannot do that. This is where the fun begins for me as I have to use all my years of experience to produce a report that counters his claim. This is going to be a fun one

I'd agree that the part time handyman work would be far more relevant, and there is a risk of diluting that by introducing motorbikes, which could drag the whole thing into a debate about how much vibration there is on a motorbike. For what it's worth, I owned a harley for several years. The bars are actually mounted in rubber. The bike shakes like a desperate whippet but there's no discernable vibration through the bars.

Social history/ leisure pursuits

Use of motorcycles should be included in leisure activities. Sources of vibration exposure and approximate ‘trigger’ times need to be recorded. Occasional use of DIY tools is not likely to be relevant.

^^Extract from the government /hse guidance. I think the issue with bikes is the length of time you are holding on to the bars for, which could be several hours rather than short bursts of heavy vibration with power tools.

My street triple is quite "buzzy" but I don't ride it for anywhere near long enough for it to be an issue.

Bike is only being introduced as a contributory factor along with the handy man job. Both are likely to have imparted vibration but we will never know how much. The whole situations rests on the not knowing, it's easy to argue that it's his non work activity that's the primary cause, but I will never have any data to prove or disprove so it becomes a contributory factor. So the rationale is how can he be so sure that it's only his work related vibration that is the sole cause of the issue. Vibration is vibration no matter where it comes from. Coupled with his grossly exaggerated time of 30 seconds to drill a hole as per one of my earlier posts and failure to declare an underlying medical condition of CTS. How come his CTS is only affected by his work activity but not similar home activity. CTS does not know if the vibration is from work or home activity.

Also this individual has a NEBOSH Certificate, is the manager of dept and has been trained in conducting risk assessments etc. he realy doesn't have any foundations with this

it's not looking very good for him!

If he finds out you've been discussing his medical history on here I could see you paying out haha. From what you have said it's clear to see he's just trying to get the cash from a claim! I've had injuries at work before and haven't claimed because I was more bothered about going back to work the next day! I've been trained how to use the machines I use, any injuries I get I feel are my fault for using things wrong!

Ive discussed in a fair bit of detail here but I've been very carefull in not giving anything away that can be traced back to him.

Mate of mine is a gas turbine engineer, he was using a 4" grinder to cut a slit in a 1m diamter ring gear so it could be removed from a fly wheel. The gaurd had been removed from the grinder, it's something we probably all do or have done. However he has cutting into the ring gear at the 3o'clock position, as the grinder went all the way through the ring gear dropped on the grinder causing the disc to jam, shatter and be ejected violently. A section hit his artery in the left arm causing quite a fountain of blood and resulted in 3 weeks off work. Needles to say there was no claim to be made here and he was very lucky he didn't getvsacked as this was known to be a high risk activity where accidents had happened before. The instruction was to always cut at the 12 o'clock piston so the gear opened outward thus not pinching the disc.

Ah, we've just had this vibration thing at work. All our had bikes are Honda 500's but they have all different ratings. Mine is hydrostatic and the vibration is low. Chainsaws got a big mention. So much so that they were taking them off us, we are a forestry company!

Chainsaws are probably one one of the worst offenders with the situation not helped by the fact you work outside where the cold aggravates things. There are ways to work around this

Since he didn't communicate at all, didn't sleep and ran around the house picking things up and throwing them in the air continuously, all I could do was laugh...
