it reads to me ,,,, no matter what you do as the boss , its all grand , right up to the point when it isnt and then no matter what youve done , its your fault.
Almost correct
It then rests with you, whatever you're doing, whatever responsibilities you have, to have the knowledge, training, and experience... to make sure it doesn't go wrong. This is the whole driver for health and safety.
(I'd argue that there is crossover between knowledge, education and training, to some extent, depending on the role)
In particular, the knowledge of exactly what or how it can go wrong, the severity of the outcome, and what you are doing to stop it. (Oh wait... isn't that the definition of a risk assessment?)
No, you can't account for all the stupid actions of your employees, but you CAN make educated guesses as to what they probably will do, and therefore what you're doing to stop them... The idea being that you can stand up in court and prove you followed ACOP and did everything you could, therefore passing scrutiny to the next person down.
This is how I understand H&S and has an impact on how i carry out all of my duties at work. To me, the very best applications of health and safety are generally common sense written down, and I've had numerous professional consultants/trainers/lecturers tell me this.
Make sure it doesn't fail, is the best rule.
The 2nd best rule is, make sure you conform to all applicable regulations.
The last best rule, is... if you do something illegal, don't get caught
