The government is good at thinking up stupid legislation but useless at actually doing anything useful. And we pay them for that !

The trouble is the window industry were given chance to sort their act out, as people kept being trapped in fires, and injuring themselfs on broken glass,
they didnt, so everyone has to conform,

Sadly it doesn't work like that, if you do the work they can force you to replace the windows with ones they approve at your expense, even if they are identical to the ones you put in

I think you have to pay to have them inspected and certified.

You have to notify the council prior to the commencement of work and have them assessed by/under FENSA regulations upon completion.
Building regulations apply, planning doesn't if your replacing "like for like".

The assessment should be free.

Then you'll be supplied with a certificate from FENSA to state that they comply.
FENSA registration is required irrespective of whether you replace like for like or not.

It's now a legal requirement to produce the FENSA certificate to the conveyancing solicitors upon sale of property.


The FENSA registration is usually completed by the uPVC company installing the windows/doors as they are "approved" so do not need to notify the council unless the building is subject to planning laws or inside a green belt area.
If "you" do the work it is notifiable.

Depends whether anyone will certify some one elses work?, not very easy to get electrical work certified since "part P" came in.

no problem selling the hose just pay 75 quid and get an imdemnity 4 them thats all a customer did who i work for. they had wooden windows made and same thing not registered . same with the conservatory its all bull./././it

The laws been changed I'm afraid, indemnity or not, you need the FENSA cert


Edit: Conservatories aren't covered unless there are no adjoining doors to the property and porches aren't if there is an inner locking door before entering the property.
If there are no adjoining doors to the property from a conservatory but the customer has stated they will fit them at a later date this provides exception under the allowance "they haven't got round to it yet" as the time frame is indefinite

For the record I work closely with planning and the council on these matters on a regular basis.


Edit2: As the sale of properties requires conveyancing to take place by solicitors, at some point, the solicitors are now required to check for FENSA registration if there is none present, it is at this point the alarm bells start ringing for them if the windows are deemed by an independent surveyor to have been changed at any point by the current owners or previous.
In the case of having been changed by "previous" owners a whole can of worms opens up as under FENSA regulations the windows can be deemed "unsuitable" and then "replacement with windows/doors meeting the required standard is implemented before the property can be sold"...


If you don't agree with this both FENSA and your local council will be able to clarify the matter for you

Sadly that's the very reason that all these regulations, etc, are now in place...
And I know just how big that "iceberg" is, try dealing with HMRC on chemical licensing, you wouldn't believe what some people do thinking they're allowed to on the basis "it's my land and I can do what I want on it and store things I want to, it's my property and it's private"


Whilst some see it as "meddling" by the councils, etc, it's put in place to protect innocent people from cowboys and rogue traders, etc...

Likewise, no offence intended


If everybody followed the regs and requirements then no more would be created and I wouldn't have the mountain of paperwork on my desk that I do everyday and may actually be able to get on with something meaningful and worthwhile

SO what happens in that case?

one of the windows didnt open enough, they are swapping the easy clean hinges,
they never thought they may need to climb out of it, the staircase comes down into the kitchen.

the indemnities are against the council prosecuting you, not that you wont die from someones bodge.

That's quite worrying .... When a Fensa registered company is lying and uses the logo and old paid for paper work then ups and scarpers leaving the crappiest job around.

How long has the legislation been in place that you must use a Fensa company and have permission to do things .
Just over 8 yrs ago I was only advised to use a Fensa company if I did not do it myself though I did have to read up and make sure it complied with the regulations in place at the time and nothing was discovered about BCO stuff. I've sold up and moved here to South Wales since it was done there was no come back from the conveyancers or any questions asked about the obviously new DG & all glass conservatory.


I've just had a brand new front door fitted four weeks ago by a " Fensa registered " company . It varies from the original because it has a low threshold so perhaps cannot be considered as a replacement like for like.

Nowt was mentioned about permits or BCPO interference .. should I try and follow it up and get it registered etc. etc. ?
