I typed b previously because I saw that as the simple thing to do if you want no contact with the neighbour.

If you don't mind chatting to the neighbour....

I would knock on the door with a "I am putting a new fence up pal, ok with you if I chop those weeds back a bit"

You may find they come and help and you end up friendly neighbours, of course they may not and so what...you put it up as plan b and leave it as that.

All seems very easy to me

The OP said it was his fence on his side of HIS boundary.

Many council/housing associations have common boundaries where one fence was put up exactly down the boundary line and neither tenant had the right to it as it was the responsibility of the council/housing association, but things have changed now.

I reckon a good relationship with your neighbors is way more important than a bit of weeding.

Different people have different values. If the weeds bother you, but not them, how long would it really take just to cut them back, after a quick "hey, do you mind if i neaten up the border a bit?"

Unfortunately its often like that now Julian, when it is and it works there is no problem, but when its not it can land someone in a lot of trouble without them realising it and in such cases it is often better being prepared for the worst case scenario, and not having to actually use the full force of the law.

Anyone who gets the solicitors involved with such petty things is an idiot.

My old man made plenty out of being an expert witness in boundary dispute cases (building surveyor) and would, and has, said exactly the same.

The "point of principle" is what solicitors get rich off.

That's the point Julian, you don't need solicitors involved, by remaining under common law you keep them out, and have the back up (if needed) of the law backing you.

I feel you are straying a little here as this is not a boundary dispute, it is causing damage through someone's actions.

your allowed to trim back up to the boundary line no further dont go down that rd if you do trim off your side rules of thumb you have to offer them back to the neighbour as there property take photos mind you saves the hasle if you can prove before and after results

as for fencing up your side you can do so as long as its on your side of the boundary line or old concrete posts leave them in and take photos

In the instance I mentioned earlier in this thread, my obnoxious neighbour started the solicitor's letters after being very abusive to both me and my wife, when your neighbour can't talk to you in a civil manner and starts sending solicitor's letters what can you do but get your solicitor involved ?

I wasn't aiming it at anyone (and, in truth, i don't even remember reading your post) but more of a general comment on how things escalate at the expense of everyone involved (except the solicitors).

Obviously, if something has progressed to the point where one party is commencing legal action against another (which clearly supersedes "petty" regardless of the initial cause), then there's a limited range of options left.

In that case, you're already both going to loose.

My house plans state which fence I am responsible for and which is my neighbours. Apparently it's reverse to usual and when the new neighbours years ago had a fence blow down they asked us when we were going to fix 'our' fence only to find it was theirs

Anyway, I would not put up a fence inside the boundary line. Odds-on they will then dig up their fence and claim six inches of your garden. When I did my fence I dug the old posts out, made a big show of marking out the boundary line with string and yellow line marker then planted new posts, bang on the centre line. Turns out the fence was well into my plot but the measurements told the truth and I took a photo from the top window which showed the original deviation. Anyway, the neighbours were cool with it because they got a new fence up as part of the deal.

I'm with the above - just go and talk to them but be positive especially if your deeds say it's 'your' side. "I'm pulling down that old fence to put up a new one so it's more secure for both of us. I'm going to have to use a strimmer along the boundary to make room to work - Are you ok with that? I can do it all without trimming the long grass back but it'll be a nicer job if I do". If they say yes happy days. If they say no do it anyway.

I had similar, except (english) neighbor absent and nobody seen him for 9 years (we tried to trace...). I put up with being invaded by snakes (few incidents dealing with half a snake in the mower occurences...) and other wildlife from the above head height of brambles and abandoned mess pulling the fence down between ours and next door and tried the legal council route who kept shirking it because it wasn't actually abandoned technically, until one weekend I snapped and just cleared a massive strip of it to bare ground with the jcb and lo and behold the guy turns up when the jcb is still parked in his back garden surrounded by devastation! It could have turned nasty about here and I was daft for putting myself in the situation borne out of frustration, but both sides kept a cool head and he said he'd have done the same thing in my shoes, he'd turned up to sell the place and we agreed terms so the entire problem is now resolved permanently.

I'd say just let them know, it doesn't cost anything and might yield positive benefits for your living environment. If they're tossers just revert to plan b without any guilt.

I had similar problems 20 years ago on a newish build housing scheme /estate of several hundred dwellings.

Lots of them had been purchased under the right to buy shceme . When I looked into the deeds before buying I found that there was no reference to boundaries . On asking a solicitor about it they said, " if it's not marked on the deeds that you got for the sale it is a common resource & should be shared costs to replace . However if there is no legally binding codicil in the deeds the other people can offer you a penny as part of their share as well as saying things like , " Well i wouldn't put up such an expensive fence .....two , two foot posts with a single strand of wire tied to them is what I'd make a separation fence out of " .


So in the end I purchased a 12 " chop saw , made a five metre extension table out of wood & cut up a truck load ( precisely calculated at least three times ) of fine almost planed finished sawn that i Green Cuprinol treated to make 6 x 4 heavy fence panels. They were secured with zillions of long thin stainless steel wood screws that I prchased in bulk ( around 3 ,000 ) & made a 2 foot high top weather strip capped panel of lattice made from treated roofing battens . Again all stainless steel screwed in pre drilled holes . These six x six foot sections were slotted down concreted in 9 foot recycled rot proof brown plastic H section posts ......as they have an active life at least 30 years unless sawn down or burnt .

Along the bottom in between the posts I cast a full post width 12 inch high gravel concrete step & once dry set three red engineering brick on the step to lift the panels up to let air flow under the panels & allow small creatures to pass freely under the panels .. That height was not a random gues either it was because the evening & mornings dews condensing point at ground level is around nine inches off the mean ground level . Rise the panels above the height by another nine inches with the extra concrete in the step & the engineering bricks turned on their side & the bottoms of the panels resist will wet rot very well .
My current larch commercial made home treated panels where i now live sit on such an arrangement are all 12 & 1/2 years old , none have any bottom rail rot to date but one or two have become wrecked at teh top weather rail due to rain filling the holes made by machine inserted nail holes in the upper faces of the top rails .

I set all 26 sections that I made for the three sides of the garden four inches inside all the chain link posts on my side of thiungs & got my lass to take photos of me by my handiwork , holding an identifiable dated copies The Times newspaper as evidence as to what was there prior to & after my handiwork.

The old dear & her hubby next to me in the other part of our semi detached bungalow that was new town authority owned had a bit of a mutter till I said , " Well if you like I can comply with the law , cut the plants you own down that are now coming through on my side of the fence line & drop the cuttings over on your side of the fence as you still own what was intruding in to my garden or if you want I can take them down the tip . What would you like me to do "? I ended up taking them down the tip a few minutes after cutting everything well back into the chain link fencing .

The neighbour at the end of the garden who had the most wrecked fencing didn't say a word . The other next door neighbour in the adjacent set of semi detached bungalows said , " Thank you , that fence looks lovely & it'll stop the postie & others taking a short cut across the front lawns .

Total cost for the chop saw , wood for the extension bench & all the other wood was just over £ 600 The posts being 9 foot recycled plastic ( much lighter than concrete reinforced ones & gentler on the hands ) were abut £15 each 27 times
Panels ready made at the time 20 years ago for a 6x6 foot were about £16 plus Vat @ 15 % times 26 & H section concrete posts @ £9 each plus vat .

Each post hole & cast step took a bag & a half of cement and about two barrows of mixed ballast .

I work for an HA and fencing is the same as for everyone who has a property - ownership determined by deeds/land registry search - if no indication as to ownership we would maintain on a shared basis 50/50 if the private owner adjoining agrees. Anyone can fit a fence inside the boundary line but yes there is a duty on the tenant to keep their garden tidy. If we received a justifiable complaint we would ask our tenant to tidy their garden up.
