boiler gone

Hi all ,moved house 10 weeks ago , bought and sold as per usual , recieved a call from the estate agent ,the purchasers of our house have been in touch with our solicitors because the boiler has been condemned after failing today,
the purchasers are I think going to try and get money from us , they had a full survey during which the surveyor inspected the boiler and noted it's serial no which gave it's age etc , we had it serviced
12 months ago and it worked just fine on the day of completion as I had a shower and no problems.
If I am right in my thinking there is no responsibility that can be laid at my door as the house was sold with no warranties implied or given, caveat emptor and all that ,so am I correct in my thinking?

I doubt they have a leg to stand on (no hot water either), especially if it had been serviced by a competent person approved by the normal gas laws etc.

Proper legal advice would be better though

Find out what it failed on.

Our boiler, covered by British Gas, fail every year on the flue location.
They can not do anything about it, as it was correct at time of install.
So, best bet wait.
I don't think you have a worry.

It's a bit rubbish for them, but if there was nothing in the survey and/or they bought it anyway accepting the age/condition of the boiler without trying to negotiate a reduced purchase cost to replace the boiler I would have thought they are just unhappy it's happened so close after buying it.
Your solicitor should be able to advise you though. I would have expected them to get in touch with their own solicter if there were grounds for

Ask for a copy of the report - they may be trying it on.

Hi, Are they going to get you to pay for the redecorating as well because they don't like the wallpaper you put up? Any mechanical object can break at any time, it happens. As you say caveat emptor.

Tell them to do one, the age of the boiler is only to do with the epc, it broke down after they bought the house and is therefore their problem

sounds more like to me we dont like the boiler now so we want a vailent boiler installed instead

as goes for the boiler not working strange why its worked in all this time touches winter and it dosnt work, parts do go faulty not even a fitter can tell you when the part will go

The purchasers had a 4 hour survey conducted which included the surveyor looking over the boiler, flushing the toilet running taps,viewing in the loft , damp tests etc, he was afforded every courtesy and given free run of the house , the purchasers were also shown the same courtesy and had 3 visits to the house totalling in excess of 6 hours, no attempt to hide any thing was made, indeed the husband is in the building trade,
I can understand the dissapointment they must feel , when we arrived at our new home the drive was full of rubbish ,the garage and shed were also cluttered with junk, we have note from the vendor apologising for not cleaning the property before moving out , I could have had recourse for this but decided to swallow it as they were an elderly infirm couple, so although I have sympathy for them I am not willing to pay, the boiler servicing company will have records of the last service,the solicitors have been informed via the estate agent of the company,we will wait and see , the epc chappie checked the boilers serial no and then determined it's age,

Not got a leg to stand on, they should be making their claim against their own surveyor, or perhaps they've tried this and failed so are trying it on with anyone.

Did you offer them a guarantee with the property?

Surprised your solicitor didn't put them straight in the first place. I would understand if it not worked on the day they arrived but they are having a laugh.

Yes the initial contact was from the estate agent the message left "just a courtesy call",
Immediately I thought someone is after something, the buyers practically ripped our arms off to buy the house volunteering 15k over our asking price and couldn't wait to move in , it is reassuring that the consensus of opinion is of no liability .

Total waste of money. Not worth the paper they are written on. Mortgage Co's like them, god knows why.

Hi, Yes, the basic mortgage companies survey is just proof that the property exists.
