What gets me about all of this is the media keeps painting these companies out to be the bad guys when they should be pointing the finger at the people who set the testing procedures that are so easy to beat, they are the real villains here.
If a engines ECU can work out that it's having a MOT test rather than being driven and switch to "super-duper-clean-mode" then the problem is with the test because it in no way reflects how the vehicle is actually used.
Don't blame the vehicle manufacturers for giving the customer what they want i.e.
1) a car that is nice and responsive to drive
2) that also gets decent fuel economy
3) passes the emissions test (MOT)
It's the same when the government complains that companies are using "tax-loop-holes" to reduce their tax bill, well who wrote the tax laws in the first place ? try blaming them... oh wait that's the government fault, erm we need someone else to blame........
Edit: thanks for the link Robotstar5, ok with Harley it's a slightly different story but who can blame a company for selling the public what they want, again we should blame the authorities for the loop holes that allow such a device to be legally sold.

If you read the article, the fine is over the sale of the race tuner which is similar to engine tuners like Dynojet etc.
The US Environmental Protection Agency (EPA) has fined Harley Davidson $12M (£9.12M) over the firms Screaming Eagle Super Tuner device, an official plug in module that allows owners of certain models to modify engine parameters, altering performance and potentially increasing emissions.
The current motorcyles meet the regs in standard form.
Fitting of aftermarket exhausts, air filters, camshafts etc usually requires and engine remap to get the most from the changes.
The race tuner allows for tuning the Air Fuel Ratios etc. As do Dynojet tuners etc.
Its sold and marked as "Not for Highway use".
Just like the exhaust cans etc fitted to most Fireblades/R1s/Gixxers are for "Race use only"

-its purposely called a "race" tuner as its not for the road .
I forgot to say, the EPA possibly went for that tuner because it does not stay on the machine, thus cannot be found if the machine is inspected. Many of the early tuners stay on the machine and can be seen at MOT time.
But if current tests are with Exhaust gas analysers, what is coming out the tubes is whether the machine is compliant, of course the supposition is that riders will remove non compliant exhausts etc and remap AFRs for the test, then switch back after???.

Lol..................maybe HD riders need the "Race Tuner" to up power to 25bhp or more, to help performance after they fit 1/2 ton of chrome ROC add ons?

Harley had a race series hear a few year ago but they are definitely not any kind of race bike!
Looks like to old water cooled V Rod engine is gonna need to be dusted off.....
They did actually make a few quite competitive race bikes in the past, but these were nothing like the lumbering low power road machines they make today.

Yeah great looking old race bikes, if I'm correct the XR 750 is still holds the record for winning the most races! Anywhere!
(I won't mention the US race authorities banned importers bikes for a time)

What actually happened was that the AMA put in place rules which meant HD had advantage over imported bikes, which had to be 500cc against 750cc HD's. Seems a real shame HD dont make anything along the lines of the old race bikes today, and have gone for chrome be-decked whales, about as far away from a light powerful race bike as its possible to get..............

Not ridden an XR race bike no, but have ridden road bikes. Get the feeling that if I had tried an XR though I would have a quite different opinion.

Let's not be naive - they called it a 'race tuner' because the word 'race' appeals to people and so does being able to brag that they 'race tuned' their own bike. Plus they sold 340,000 of them so they can't really argue that it was aimed and intended solely for race use.
They came up with some slick product marketing and have shot themselves in the foot in the process.
