Funnily enough I have just spoken with him ^^^ re another matter, and asked him the question, he said either side would be ok in HIS eyes , as far as he knows no president has been set to this situation and common sense would prevail, but that is in HIS view, another might take a different view, as it is ok to pass on the inside when conditions prevail and is illegal to be in the third lane with a trailer I would still take the inside route because I would have had to change from the first lane to second to third overtake then comeback to the first, when I was in that lane to begin with. I also would not be flying past the truck at 30mph faster speed, I eased back slowly passing him, giving him time to see me, then accelerated back to normal speed.

As the gritter driver has to be in the middle lane, I think that would give you the right, as is stated in the lettering in red. As long as you don't do the wording in blue

In these conditions you may keep up with the traffic in your lane even if this means passing traffic in the lane to your right. Do not weave in and out of lanes to overtake.

Exactly if the traffic is relatively free moving you shouldn't even if there is a total (add what words you like) in the middle lane.

Where as this special situation normspanners has further pointed out that you can use your common sense.

Also if there is congestion in the outer lanes down to crawling pace and it dictates that undertaking will happen this doesn't give you the right to do 70mph while they are crawling. You should reduce your speed to a reasonable value to account for eventualities.

A few mths ago I nearly had an accident on the M62 because of the stupid idea of traffic lights on the slip rd to motorways, meaning that at times you get a massive amount of vehicles, including slow trucks because they have been stopped, etc entering the free flowing traffic, bringing it down to slow speed.
I was in the middle lane with a heavy vehicle on the trailer and had left a reasonable gap to the car in front for me to stop if needed. Suddenly all these vehicles joined and cars started going everywhere out of the centre lane to the third etc etc but the centre lane was traveling slightly faster than the other two until two cars decided to take my gap one from the first lane and one from the third lane instantly leaving me NO space, then because all this happened they braked hard, I had to slam on and virtually locked all 8 wheels, even had to grab the handbrake on the disco whilst cadense braking, if you have a disco you know what happens !! well I stopped -----about one inch from the car in front--- then my rig disappeared in rubber smoke !!
Had I hit the car in front it would have been my fault, even though I had left enough space for me to stop, and it was this space being filled, that sort of caused the immediate problem, the real problem was the stupid traffic lights allowing an influx of slow traffic
That would have been a perfect time/need for a dash cam!!

Wrong or right, I was told by the copper that booked me for overtaking on double whites( at 2am, on a bike, with clear vis and no oncoming) that the only time you can consider driving such as that, ie against normal laws, was moving round a vehicle displaying an orange flashing beacon and moving slowly

Highway code says to pass something that is stationery, nothing to do with flashing lights etc.
They class stationery as something moving under 10 mph as I recall.

Don't feel bad, they did me for the same offense on a bike when I was committed to a overtake and the vehicle in the lane next to me swerved into my lane, forcing me to take refuge in the empty oncoming lane to avoid a collision. A paranoid person would have put some weight behind my friends theory that the vehicle doing the swerve was a unmarked and it was a bit of a sting but I was too busy staying alive to stare into the car like him who was a few vehicles back.
When at the side of the road having been pulled over by the full on starsky and hutch manoverer by a regular patrol car a few cars back and getting the "chat" my friend pointed out that he had done the same, but entering into a blind bend, in a patrol car, with nowhere to get out the way,in the most dangerous fashion you could imagine, he called the vehicle inspection squad out to inspect our vehicles "as they were clearly unmaintained death traps". A hour later having had them partially disassembled at the roadside and no defects discovered, we trundled off without my license because I was actually guilty of the offense whatever the mitigation, waiting for it to be returned with 3 points on it and £100 lighter. Only for them to fail to process it "because the condition of the document was too bad", make me apply to dvla which meant getting a replacement photocard (and it was when they were introduced and the dvla had a massive backlock well publicised), then prosecute me for not having a valid license and insurance in the meantime as a result for which I attended court and got 0 pp and costs awarded against sussex constabulary.
And traffic police wonder why certain members of the community dislike dealing with them. Its also the trigger event which lead to much more interesting things in my life (emigrating to get away from the attitudes!).
