clearly there is no penetration, therefore all the other welds are suspect too

Firstly I agree with whats been said. The weld has no penetration.

But what I would like to know
What sort of bed has a leg in the middle
and
How the hell did you break it

It would appear that the steel used is so thin that it need extra supports.

Not only that, but I wouldn't be too happy at a bed that has two sides that are spring and a hard bar in the middle, surely that can't be comfortable?

My niece and her husband had one like that and where the welds didn't break the steel pulled apart. I must have welded 6 different breaks over a few years, I told them to tone down the athletics a bit

More comments: I informed the seller of the malfunction with the bed via ebay and they then referred me to their support centre email address outside of ebay. after supplying the support centre with pictures of the bed frame and malfunction, the seller said that it was due to 'accidental damage' and had been caused by 'inappropriate movement' of the bed. The seller informed me that I was have to pay £15 for a new internal frame. I have had this bed for 2 weeks.

The pictures which I have supplied to you are of the bed after the fact which obviously shows the legs now sitting at an angle. It is impossible that you can know that this is the cause and furthermore it is completely untrue. I have it on the authority of several welders that the welding join securing the leg was to blame as there was absolutely no fusion of the two pieces of metal and was what they refer to professionally as a 'cold weld'. Had it been, as you said in your email, caused by 'inappropriate movement' or indeed as you are now insinuating inappropriately/incorrectly constructed (which you must be, because it's not like the leg has a variety of settings and I had it on the wrong one!) then in the words of the welders 'it would have torn the parent material if stressed by incorrect movement' which it clearly did not. There are two emails also which contain the magic phrase 'inappropriate movement' and just so you all know the images I supplied to the guy are the same as I have posted on this forum and a couple more but minus the very first I posted here which i took just for you guys. I'm saving that for trading standards who I am now contacting

That is one of the best examples of a cold weld I've seen, no fusion, I'm not even sure it should be called a weld. It is so bad. Good luck with the seller.

Whilst it may cost you dispatch, it'll cost him more through the negative complaint through PayPal, and having to supply a replacement FOC

Contact trading standards too, or Consumer Direct as it is in this case and they'll put pressure on

I would want a full refund, not a replacement, the new one will more than likely be just as bad

if that is an ebay dispute you also want to raise a paypal dispute.... thats the one that will hurt them financially

Here lies the problem, whilst you can claim for the product you have to pay for any transport costs yourself unless the seller, or company supplying it, are willing to cover the costs...

It's a loophole in trading standards that some companies use to their advantage, it applies outside of eBay too...

You can usually verify that a seller, on eBay or otherwise, is selling substandard products, or is unreputable, when their transport costs are unusually high, or unusually low, as they are under no obligation to refund them. Or it cost's a fortune to return the item.

Why should the seller pay for the return postage? It's the same whether an item is bought online or in a shop. If you buy something then take it back to a shop you don't bill the shop for your expenses.

Utter rubbish . It has nothing to do with distance selling regs it's simply a breach of contract and comes under the sale of goods act.

Funny how this issue looks very similar to my first 'job' with the mig welder.

My boss had a bed frame which he wanted to sell, but the main side strut of the bed was damaged as the end plate with the bolt holes on had snapped clean off.

It was exactly like the photos in this thread, a completely cold weld with no fusion whatsoever, I ground it back to bare metal and welded all the way round the tab.

The bed is now solid, well on the joint i fixed, as all the other welds look very similar to the cold weld.

Shoddy, cheapy workmanship on some of the stuff available nowadays !!

Glad I bought my welder !!

This whole thread is about faulty goods. Distance selling regs DO NOT overide a sellers obligations under the sale of good act.

you clearly didn't read the link I posted. Perhaps if you won't take the Office of Fair Tradings word for it perhaps you'll believe the BBC?

"The retailer would have to pay for return postage if the items are going back because they are faulty or not as ordered". Which is clearly what has happened in the original posters case.

I've just had the same argument with an ebay seller who sent the wrong item.

He wasn't prepared to pay for return postage so I quoted the Sales Of Goods act etc etc.

It was a heavy item so postage was a fair whack. He conceeded and gave me written confirmation of refunding the postage before I sent it back.

Funny thing is I did alright out of it because I charged the same inflated price for the return postage that he charged me for sending it in the first place

The buyer shouldn't be out of pocket and doesn't have to return the item- they just have to keep it in good condition until the seller collects it.
