A mate is having a hard time with his Riley Elf.
A saga is developing. The plan was a cheap runaround with no depreciation.
Ha Ha Ha.
He has just rewelded half of it after an engine rebuild.
It failed it's MOT, he reckons unfairly (maybe the MoT guy does not dreadlocked Belgian hippies).
Can he take it somewhere else for a second opinion or fresh MOT, or is the first one binding?

He can make a formal complaint (to VOSA?) but he must not have any work done on the car until it has been inspected by them.

If he took for a 2nd MOT the new guy will details of the fail on his computer which may cause problems.

MOT test isn't binding, it's only a spot check in effect (i.e. could drive out of the test centre and damage something that'd result in a fail if it were re tested) but as RTB said with the system being computerised going for a fresh MOT the tester will see everything it failed on and all/any advisories when he logs the car in. Some of it's black and white some is 'testers opinion'...

To avoid it being picked up by computer take it for a "pre-mot" tell the tester he wants to know what work he would need to do for a pass, then compare the 2 results, if they don't agree (within reason) take the matter up with VOSA.

Just take it to another mot station and explain whats happened and ask them if they would check the fail points and see if they agree it should have failed

it wont come up on the computer at the next mot station as the tester would have to know the fail certificate number to enter it im not sure its even possible to look at the history of a vehicle on a vosa mot system those systems are still a dial up system not broadband and you have to have a dedicated phone line that will not accept incoming calls.
all that happens is the tester logs on enteres the reg & vin goes away and does the test then enters the brake reading and wieght of the vehicle vosa's computer then determins if its a pass or fail on the brakes, the tester then enters any other defects he has found

tell him to get his second opinion he will have no problems

slightly drifting away now but

in the vosa magazine sent to mot stations a guy set up a mot station and in the first six months he never failed 1 car
he was prosecuted for dodgy mot's so there are testers that will fail things to get work and also testers that will take a bung to pass the car

Not entirely sure.
I know he did a load of welding, replaced on rear wheel arch and patched the bottom of the boot.
He thinks that the MOT guy did not like the look of him. There is a small bracket in the boot, non structural that is rotten, and a few pinholes in the body work.

I know nothing about MOT's or vehicles, I am just trying to help him with a second opinion.

I've had depressing MOT's before now, even more so when you've already done a load of work.

MOT testers do get nervous passing marginal stuff, and fair enough. Too many cars get sold on straight after the MOT, buyer gets miffed car has rotten boot floor, complains to VOSA that it's just had an MOT, tester gets unwanted visit from the Ministry. Only a few visits I think sees Tue testers licence revoked and that equals bye bye livelihood.

If it's just some more welding, and your mate is doing it himself, address the fail points, take it back to the same place, leave the old fail sheet on the passenger seat, and bingo, new MOT pass.

It will come up on computer before the nominated tester starts a test he logs on and enters the reg number, the computer then prints a V40 (iirc) this list the make model engine etc and any special circumstances specific to that vehicle the tester should look for or adhere to. My galaxy comes up with half a page Like play acceptable in top strut bushes etc etc.And things like both wheels to be or not to be raised when checking play or not to use brake tester on limited slip diffs etc

i agree with neilh it could well be within the 30cm what is the bracket for ?
as for pinholes in the body work they can fail it if it has sharp edges likely to harm someone

Send him to the local government official one - at least you'll get the bottom line verdict without the tester panicking, a vested interest in doing the work or any comebacks Afraid he'll have to live with the Belgian aspect though
