I think that if its evident to a tester that an EGR has been defeated that its a fail....but its an oddball situation to have one on a car that shouldn't have one originally.
I suppose the engine in the car was designed to have an EGR - so it should be present.
However - a blanking plate in the EGR manifold isn't obvious without dismantling - so as long as it passes emissions......
(My old LDV with a Ford 2.5di engine - had better readings after I'd blanked the useless, pointless damned thing!)

You can only test what you can see .
You can not see a blanking plate .
It is great shame the way they have strangled modern diesels .
The test still only measures black smoke .
Not the nasties comming out of the exhaust .

Pass - if smoke readings OK.
Technically if the tester can see emissions control system tempered with - it is a fail. But in reality they will only be looking at the exhaust system.

You will normally see a little data plate on the slam panel, on that there will be a code like 1.8 or 0.9, there are many different values, that is the emissions value the vehicle year/type was approved to. so they will test to that.
you do see them tampered with, that is an instant fail.

If the data plate is missing or illegible you test to the default value for the year of manufacture .
This is higher than the plate value .
Land rovers don't display a plate for some reason

This subject came up a while back, I have blanked off must of the egr valves on mine as and when they cause a problem. They always pass the emission tests, that said most diesel testers rev the granny out of them for the test and on most of the older vehicles the egr would be shut at this point .

I've recently cleaned out the EGR system on my car and even at just 70,000 miles it was full of soot. Inlet manifold is the same 
. I'm making some stainless plates to blank off the valve, whilst leaving everything still in situ, as don't fancy cleaning it out again if I can avoid it because such a nasty / dirty job !

All my diesels are blanked, and have had the cats knocked out of the canisters. Never failed emissions, even the Trafic (now gone to a new home) with a DPF.
As long as there are no clear signs of tampering all this can be got away with.
Not sure about a roadside check by VOSA though, where they might be looking specifically. If the vehicle was not new when you bought it, can just claim ignorance.
