Doesn't it depend on application, and consequence of failure? That part doesn't look new, but it could be how it's fixtured during manufacture (poor design) or it could have been fitted and never used, or it could have been used on a track day and returned (full of stress and ready to snap). The marks show it's history is now unknown and would a user be willing to take the risk?Was it in a sealed packet when it arrived as most parts appear to be?
Ultimately if it fits is there an issue?
