Nonsense. That is an inherent defect and you have six years to bring a warranty claim against your retailer, under CRA 2015. If you paid as you should with a credit card, you also have the Section 75 protection.
Or was it (and were you aware) that you were buying secondhand?

It's not mine but yes he knew it was second hand. BUT he also knew there was a lifetime warranty on the tub itself.

probably only to the original purchaser
It wasn't as it was one of the selling points the salesman used.

The lifetime warranty is over and above your legal rights. However it is unlikely that it would be transferable. Secondhand goods are also covered by the CRA but not so comprehensively. It is well worth reading up on it before going into battle. Also consider the S75 CCA if he was bright enough to use a credit card.

i think people like kirby and such founded this type thing buy new at 3500 but if you can sell you a demo model at 1500 sell at nomal price (even then well inflated )but not inc the warrenty so you only get 3 months or 6 or a year

is a name any one uses for 2nd hand stuff its means any thing from gone to customer and they dont like returned in the 14 day cooling off period to retured at 11 months and 28 days that they cant fix on site give a new or refurb to the coustomer this taken back they power it up clean it up run it throught tests if it does not show any faults its resold as pre loved or refurbed etc

Because it is over and above legal requirements and therefore the seller can attach any conditions they like. It is very unusual to have it transferred to another buyer down the line, so if he believes that it is covered, he will have to prove it. Otherwise he will have to rely on statutory rights.
Sold as refurbished still attracts CRA and only defects pointed out at the time of purchase would be excluded. It is difficult to be specific for you without a lot more information, but read up on CRA at least.

DID the salesman actually say it was covered by lifetime warranty (what exactly is lifetime) Did the salesman know his facts ? It not unusual to find that salesmen do not actually know all that they should.
I would think it only applies to the initial purchaser, unless your mate has a sales leaflet that states any warranty IS transferrable ?

The point is why ask for the tub to be drained down and photos if you know its got no warranty.
