It should be straight forward, administrators will be appointed and they will iron out all the bugs. They will be effectively running the show while they sift through the books.Other peoples property should be safe.

Can't help you on this one.
I have had vans on my premises in for repair and the owners have gone bankrupt and liquidators have just came with lorries - knocked me for the bills and removed them.
But the other way round I can't help you with...
Would think - your need to get approach who is sorting the mess out and prove the vehicle is yours and remove it.

Voluntary liquidation means the owners have decided to close the business down. So they pay their creditors and sell everything* off. Shut the doors.
Compulsory liquidation is where its forced by those they owe money too.

Only if it is in his wifes name, and they call it "phoenix automotive services".
There is a bit of a loophole... Open a very similar sounding business name a month before and then close the existing one. No Phoenix offence then.

My old boss was an expert at it, he had Orbita Welding which he folded and moved the assets into Orbita Welding and Automation so we still answered the phone with Orbita Welding.

Closing ... you are still liable and still tied to contracts, but you also still own he assetsAs time passes it seems legit.

Liquidising iirc involves a receiver of administrator who takes "ownership" liquidises your assets and settles debits as far as resources allow. You loose assets and responsibilities

You can do a pre-pack if you want to keep everything and stuff the creditors.
I am dealing with one right now, a liquidation that is, as most of you know I pretty much do as I please at a local fabrication shop, in turn helping my pal out in lots of different ways, well, last Thursday - pre the 1st Sept, he was handed a letter by one of the "Directors" letting him know that the company set up by his father had gone into Administration. So far I have salvaged most of it, set up a new and totally separate company for him and organised the retention of assets.
What I have to do today is negotiate the lease, bearing in mind the previous company are going to stiff the landlords for £6k in back rent. They also "forgot" to pay my pal his wages for last month, which fall due on the 1st and his mortgage which is also part of his "package". It's a mess.

And yet companies house does nothing - so many comapanies trading insovlent.
They do nothing to protect the credtiors.
They even sell dormant companies for debtors to fall back on.

There needs to be a limited indemnity on executive directors... something like total liability for debts incurred from 3 months after you should have known you were insolvent. ( not were informed ... because if the accounts don't tell them they were not informed)

Mentioned it before quite recently, but my employer did that in the 80's. Stafford Fabrications.
The owner, Harold White, declared bankruptcy, laid us all off, then opened a week later as Fabrications Stafford, and invited all the old employees back.
I had found another job meanwhile. I got £800 redundancy for 11 years work.....Harold could get stuffed..
