I'm having to do some work for a farm owner who's being reported to the HSE for breaching legal requirements.
The premise is they were employed as the manager by the owner.
However after a period, they came up with the proposal that they would take over running the farm, and only pay a basic rent.
The owner said no, as the proposal was definitely not in their interests.
Roll on a few months, and the 'manager' said they were leaving, and that they'd reported the owner to HSE for failing to address various things.
As part of that reporting, they used an untested telehandler, along with a bit rope to lift a hut, and took a photo of the hut lifted as high as the telehandler would go.
The owner was a bit worried, but he pointed out, that as the manager, Health and Safety was their remit to handle, and any prosecutions would fall on both of them equally, as the manager had the authority to get things repaired/tested.
Plus the manager had already been told not to use the telehandler, and not to sling things using rope, in writing.
Anyway turns out HSE aren't actually that bothered, given the reportee's employment status is now former, and have put it down to them being vindictive, especially since the main 'evidence' was a photo which went against things they'd been told not to do.
HSE did carry out an inspection, but other than a few minor things, they aren't pursuing anything.
