Parcelforce import vat handling charges

From what i can tell, 104.2(D) is still intact.

In which case, you just need to call up the MDs office, and tell them to deliver the goods. You point out to them, at the time, that if they think there is a contract between you (the recipient) and themselves, they can invoice you thereafter, along with evidence of your acceptance of contract.

You offer to reimburse them their losses, to the extent of the VAT / Duty they paid, on your behalf, outside of contract, but re-itterate that you did not request them to do this, and you are doing nothing more than covering their losses, rather than accepting contract.

They will take payment for the VAT / Duty, and may, or may not bother to invoice you for the handling thereafter. I have not read of a single case where they have pursued for non-payment of this invoice.

I have, to date, not paid any said invoices.

None of them are mine, If you did indeed follow my link you would have seen that it was a search results page and the instructions are clear in the terms and conditions that if there is alreday a petition running you are not allowed to start another, So I searched and found those and so the one that ends in 2015 seems the best to sign, but no, none of them are mine.

I'm not sure you are correct in what you say. I have read about this stuff for hours on the net and what you describe certainly used to work and be the answer, but I am fairly certain the the law and terms and conditions were changed to stop it. How recently have you done what you claim and got away with it?
I believe if you are regularly in this position you can contact HMRC and arrange to pay your own charges, lot's of form filling and messing about which makes it too much agro for people who only do it a few times a year.

I have not had need to do it for a couple of years, but, prior to that, i used to do it quite often.
It was never a walk in the park, and, if you were using earning time to call, then you may have been better off just to suffer the robbery, but i was just sick of them.

There will always be people who say you cant do things. There were enough people saying that it was not possible when when i was doing it. The staff at the MDs office would also say it was not possible, however, if you know what you are talking about, and have the relevant documents to hand, there is no opinion required. If the postal services act has not been revised, then they are still, legally, not allowed to commit "retention by virtue of lien". If that line has been removed, then, i guess they can try. I have no need to look into the detail at present, but, if you do, then maybe ignore what people are saying who have evidently failed, find the documents, and quote them to whoever is telling you that you cant have your property.

I could put a sign outside my house saying "parcelforce is great" and then invoice them for advertising. Its quite obvious that there would be no contract in place, so they would not pay. If you did not contract parcelfarce, and the act still expressly disallows retention by virtue of lien, then it really is that simple. All you need to do is communicate that in a proper way to those who have the authority to act.

they will all try it on, however, in my own experience (again, from a few years back, so possibly out of date now) the private couriers are much easier to deal with.

Unfortunately that has changed. They have recently amended the act (section 105 4A) to allow the operators to detain the item until all the fees are paid: http://www.legislation.gov.uk/ukpga/2011/5/schedule/12/paragraph/36

I just had a chat with Parcelforce and they know they can legally hold your items in ransom now. Nothing we can do about it =/
