There is a difference between private land that the public are granted access to i.e superstore car park, communal car park or field used for a bike rally and private land to which the public are not granted access ie. private residential drive.
The RTA applies to the former but not the latter.

There you go, private land to which the public have been granted access, even if public is defined as other residents of said flats.
