Experience with B&Q warranty claims

Killed my black + decker powerfile still under manufactures guarantee 2 years, have a look at b&q warranty section which links to b+d warranty page telling me to contact the seller which is b&q, go instore oh its past 6 months contact the manufacturer, you can see a problem here how do i deal with this?

B&Q are the seller they are responsible unless the warranty required you to register with B&D, not sure how that fits in. They try to pass the buck, slippery trading
Had a problem with a light fitting not a warranty but bought a light fitting the show unit had LED bulbs got iy home to find it was fitted with halogen.
The manager said we fit LED for demonstration units my reply, "that is not what I bought there is no mention of This unit comes with Halogen not LED" had trading standards point out his error.
Notice there was a notice by the lights later

In England I would point to the Consumer Rights Act 2015, but I know that there are some differences in Scotland. Either way, your contract is with B&Q under the consumer regulations.

Didn't you have to register the product with B+D when originally purchased?

I have not had an issue.
but my Local B&Q does have a good name.

from what i remember you have 6 years on some goods

b&q are responsible for the warranty as you bought from them however on many docs they try to get you to register with the company for there warranty registration in a way its wrong as its data collection to what you have bought from any shop

when you bought it from the shop you paid for it in many eyes that shop is responsible for the warranty

b&q has always been known to fob its customers off against the consumer rights and apply its own to stuff its sells there

i have seen the police called and remove many from these type of chains when they try to return items past there warrantys using the consumer rights against them

they also get banned from the shop as well

I will got down this route if they don't replace it willingly, had it for a year and a half and it barely been used probably had a hour of use time, falls foul of the " expected to last a reasonable amount of time"

Didn't you have to register the product with B+D when originally purchased?

Make no mention of needing to have to register the product to redeem the guarantee just proof of purchase.

those terms are on your receit as well as on the webpage of b&q

the sale always states to register your product with the companies name on there servers to get your warranty from them

all companies have been doin it for years from electrical tools right up to kitchen appliances and your boilers

i think aldi or other one is the only ones that has honored the warranty guarantee all the rest dont

They never even asked if i had registered the product just six months has passed since you purchased the product contact the manufacturer, the receipt says nothing about registering it either. black and deckers warranty page states contact the seller with proof of purchase or contact a authorised repair centre.

The rules in England are that the retailer is responsible for the goods for 6 years from date of purchase (5 years in Scotland), they cannot fob you off to the manufacturer. You have no contract with the manufacturer but they might decide to assist regardless but that changes nothing legally as far as your contract with the retailer is concerned. If you have a separate warranty agreement with the manufacturer, then of course that forms a contract. "Registration" cards have no legal standing and can only add to your rights, not take anything away and there is no requirement to "register" in order for CRA2015 to apply.

If you have had the goods under six months, then the supplier has to prove that it DOESN'T have an inherent defect. Once it is over six months old, you have to show that it DOES have an inherent defect.

Sometimes it is simpler and easier to make a Section 75 claim, once the retailer has told you they are uninterested. You will have to show that you have tried and failed to get satisfaction on a S75.

A big outlet like B&Q not a small DIY corner shop, and they still try to take the proverbial.

Do these people not release that all the TV advertising they do is undermined when bad press gets shared on the Internet.

Well after emailing their customer support and a few requests for details, pictures of receipts, this took ages week between reply's, i get a email back from the duty manager from the store i bought it from saying i could send it back to black+decker or i could return it to store for a replacement as a good will gesture, pretty sure they confused the last part with statutory rights but i went in and got a replacement.

Had the same issue with a Samsung washing machine bought from Curry’s. Spent a long time on the phone to Currys customer (non) service, telling them that my contract was with Currys not Samsung, and eventually the woman on the other end got really nasty before putting the phone down. Printed off all the necessary info from the Consumer Rights Act (I think it’s on the Which magazine website), took it in to Currys and told them they were getting it back. They backed down when they saw I had the CRA info, and even helped me lift it out of the van !!
Retailers are really trying to dodge their responsibilities over warranty claims these days, and need to be told.

Keep some evidence of the date you received the replacement as its warranty should start from that date not from the date the broken one was purchased.

Sorry, you are incorrect. Warranty stays from the original purchase date.

its not just with those ive found its nearly all of them that try to get out of the cra laws

like ajl says some of them can be real fun to play with

ive found all white goods are trouble its the same with boilers as well as pumps they try and welch out of it with goto the company for a replacement
