What‘s your thoughts on this, there are some very large (60+ ft) trees, some of the limbs and branches are overhanging my mothers house, the trees are on council owned land.
These are starting to cause problems, last winter during a storm a couple of small branches came off and damaged her conservatory roof, the roof is made from a kind of channeled Perspex which is multi layered, the holes created don’t go all the way through it’s causing stains now within the damaged area.
Council are not interested, say it’s not their problem, I’ve had a couple of companies round to quote to fix it, both have said if they replaced the damaged panels they then wouldn’t match the existing 20 odd year old panels and neither of them wanted the job because of that. With regards to the roof I intend to take North Ayrshire council to the small claims court to get the roof put back to what it was prior to their trees damaging it.
What makes me really angry is that my 81 year old mother is prepared to just put up with the damage if the council would just come out and cut off the overhanging tree limbs, they point blank refused and told her that if she wanted that she would have to pay for a tree surgeon to do this at her own expense. I’d do it myself if it wasn’t that the area needing cut back is between 25 and 40ft high and I know my chainsaw weilding limitations.
Does anyone know the law about what I can legally expect them to do when I eventually get them into court because it’s clearly at the point that it’s our only course of action now.
A few years ago I had a damaged alloy and tyre which left me out of pocket and I took Edinburgh council to court as again they point blank refused to take responsibility, I won my case and even spoke to their lawyer who admitted that the reason they dig their heels in and not accept responsibility is because the vast majority of people just give up.
