cooling off period?

Quick question before I look further into this............

OAP puts down deposit for replacement door, cheque dated 10th March. I should state, customer OAP ( my mum) called this company, who in turn arranged a visit. I feel my mother is being a tad ripped off, and I no like my mum, or any other OAP being ripped off, does the 7 day cooling off period apply when a company is called to a house to quote, does 7 days include weekend or working days only??

As Hitch says, you have full 7 working days from signing

You must do it in writing, via email/fax/reg post you need to be able to track it.
Technically illegal to stop cheque before notice....but possession is 9/10s of the law.

As you have already paid for the goods or services, the seller must refund your money within 30 days of you cancelling the agreement.

I seem to remember something about if you ask them to call, the cooling off period doesnt apply,
hence why they keep ringing up.

The Doorstep Selling Regulations

The Cancellation of Contracts made in a Consumer's home or place of work etc Regulations (2008) give you protection when you buy goods or services from a trader on the doorstep or in the home (or in someone else's home), at your place of work, or when you buy from a trader on an excursion they have arranged away from their business premises.

If you change your mind about a purchase above the value of £35, you have at least seven calendar days to cancel the contract (the 'cooling-off' period).

It does not matter whether you invited a trader into your home or not - the Regulations cover both solicited (invited) and unsolicited (uninvited visits or 'cold calling').

A trader must advise you in writing that you can cancel the contract – this information must usually be set out in your contract and should be legible and have equal prominence to any other part of the agreement. If there is no written contract, you must still be given this information in writing at the time you agree.
If you are not given this information in writing the trader can't hold you to anything in the contract. The trader may also be guilty of a criminal offence, and may be investigated by your local authority Trading Standards Service.

Many thanks for replies gents, this will be dealt with today, first with canceling cheque if possible? Then notification of cancellation in writing. Turns out it was some horrible person cold calling, not as I posted above.

hope you get it sorted, I think a lot of these traders rely on people not knowing their rights. Out of order putting pressure like that on older folk.

Out of principle i never have dealings with cold callers because of these pressure tactics they employ, for most people with access to the internet these days there is no excuse for not spending 10 minutes searching for the best deal you can get.
