confusion over tax & sorn...

I've had to recently purchase another car in replacement of my other one. The car I'm not using now has 3 months of road tax remaining, and due to the fact it has no insurance now the policy has been updated with my new vehicle, I've had to sorn it to avoid getting a fine or prosecution.

I have a bloke coming to buy the car tommorow and with a Sorn, will he have to purchase a new tax disk or will the remaining tax be reinstated once the vehicle changes hands?

Daft laws never make anything clear & simple..

once he registered it in his name sorn is removed he then has to declare sorn once it's the V5(logbook) is in his name

also make sure he fills the logbook in in front of you you keep the log book he only gets the little new keeper bit you send the rest to DVLA when you do copy the log book and signatures and get a certificate of posting from post office as DVLA are known to lose paperwork then you will get a £80 fine for not registering it etc etc etc pita etc

Thanks octo007, so the remaining tax is pretty much unreusable? He wants to drive back to stoke and I wouldnt want him being pulled for apparently having no road tax...

Surely if it is "off road" then the insurance is immaterial and with 3 months tax still remaining it should not have needed SORN ? My understanding of sorn is that it applies to the road fund tax (the part that DVLA are interested in)
Might be an ideal not only to Give a receipt to new owner for the monies received but get a receipt from HIM/HER confirming the date AND time the car was received. That way if they get car home and decide to "try it out" on public road you are on paper showing as the registered keeper and would receive fine!

with the continuous insurance requirement you have to sorn it even if taxed of you will get a fine for a uninsured vehicle through the post it's all automated

For your protection though, make sure he has signed the registration doc and you have dropped it in a mailbox before he drives the car.
Great idea from someone above to also have a signed change of owners time and date receipt so if the reg doc goes missing you have it to fall back on.
Can't see why there should have any prob in the first place, so long as he has insurance, car has valid tax disc and MOT.

All this continous insurance rubbish always screws law abiding citizens whilst again the criminals couldn't give a hoot about it... (pretty much like the gun laws, only apply to the people who legally own guns are scrutinised more than people who illegally posess firearms...

Thanks for the info everybody, I have just sent him an email now letting him know the car is sorn, and have advised to bring along his driving license and insurance documents for this reason, and told him to tax the car at the next nearest opportunity using the small green slip. I shall also give him a written receipt for the car, have him sign it and also myself as recieving the money, dated and timed also will have a carbon copy of this reciept and make a photocopy of the V5C made before sending it off to the DVLA recorded delivery. This should cover me and him.

One to watch for, though it should not apply in this instance (but relevant if someone is searching forum) Don't rely on DVLA always sending out a reminder for the sorn cos I know from experience that they sometimes don't/forget? and you get a snotty letter and threat of fine (or automatic fine!) if YOU don't renew. Had to have a long chat with them as mine had gone past due date with no reminder. This was featured on watch dog or some similar program and is quite common with DVLA. Be warned if you are long term restoring a car make a note of the due date.

don't drop it in the mail box as i said and others have get the log book copied with the signatures on and dated etc then go to a post office and get a certificate of posting it's free and keep both till at least you get a letter from dvla saying you are not now the registered keeper

SORN is now - as of this years's budget - permanent. No renewal necessary. It'll expire on change of registered keeper though.

If you didn't cash in the tax when you declared SORN, then he can use it as it as far as VED is concerned. - provided it is insured and MoT'd. Theoretically - and nobody would bother to - but you should check he's insured, because while the car is registered to you, it is an offence to allow someone to drive it knowing, or not bothering to check, if they were uninsured.

You'd need to get a real tosser of a cop to report you for that, but they do exist.

you have a good point about long term Sorn, but now it should be open ended, as it was changed in the last budget. I have two cars on long term Sorn but had no notification, as yet, about not needing to renew the Sorn?

I always take v5 to local DVDs office they photo copy it and stamp it with there official stamp (plus it saves on postage) has anyone got a link to the changes in SORN as that's a real pain I borght a scrap Landy to strip for parts and have been left with a v5 and plates I carnt get rid of as the red v5 did away with scrap box

Send V5 with covering letter to DVLA and they will note as scrap.

Not tried that yet can even include the photos and eBay listings for the bits I sold! There was so little metal left in chassis it managed to buy a mate and I a sand wage after we weighed it in

Tell DVLA you've sold it and not had an acknowledgment from them that you are no longer the registered keeper (and that just over 4 weeks have passed). When they ask you for the details of the new keeper tell them they were on the docs you sent to them.

There is no legal requirement for you to send them registered so if they "got lost" after you "posted" them then it's not your problem. As far as you are concerned a person turned up, paid money, took it away and you sent the docs off.

They will take you off as the registered keeper and put a note on file that if plod see the vehicle on the road, through ANPR or whatever, pull it over and get the keepers details (which they will then use to do them for the lack of SORN or tax from the point at which you say they took posession). The vehicle will stay on their records as an unknown until they finally have a purge of records that haven't seen any activity in x years.

Anything else risks trouble due to the complete lack of common sense at the DVLA.
