Can my ex company hold my qualifications??

alright guys, basically I've left a company I was with for 8/9 years, and I've started a new job.

With my old company, have they the right to hold courses that I passed?
Forklift
Manual handling
Cranes,slings and gantry
Abrasive wheels
Fire awareness
First aid
Confined spaces.

If I got these it would mean more money for my new job, but do they have the right to not give me them?

where did u train and get the ticket. ring them up and ask them for a spare copy

Don't know the legal answer but if the certificates were issued by an out side assessor I would expect you to be able to get duplicates.

Any qualifications I've done have always been me personally, not belonged to the company I worked for at the time, so I don't see how they can "not give you" them. What good would they be to them anyway? It's not like they're transferable . Probably just being awkward cos you left. I can see it from their point that its expensive to train people if they then leave, but that's probably why you'll get more at the new company cos they don't have to pay for your tickets.

I left this company twice, first time I left on great terms, I was leaving the country and they gave me certificates and even my codes for welding, now I left on not so great terms, I don't want my codes I just want my certificates lol

In IT the usual caveat on training and certification is that if you leave with a prescribed time frame then you have to pay back the training cost.
You still have the personal certification and this can only be inforced if you have agreed to it in your contract.

If you completed the courses and certifications and they are in your name then they should be yours unless otherwise stated.

You can request a copy of all data held on you, and the supplier is limited to a maximum fee of £10 for providing it.

If they're total .....es they will destroy it before giving it you, however, its standard legal stuff otherwise. Includes all emails mentioning you, et etc. Everything for a tenner.

I'd have thought if the company paid for the courses they don't have to give you anything.
When i was being made redundant a couple of years ago i made copies of all certificates before i went.

In your contract did it say that you would have to pay them back for any training costs if you left after a certain time? If so and if you don't owe them any money then you have effectively paid for the courses and they are yours.

Note -

If you go shopping in tescos, you can demand all the CCTV footage of you in their shop, max charge, a tenner.

I use this as an example, not a suggestion.

Again, all data held on you for a tenner. Doesnt matter who paid for the courses or anything like that - if they hold the certificates, you are legally entitled to them, as they are data held about you.

I'm not slightly sure of this - I am 100% certain.

Hi, Everything apart from fire training and manual handling (which each company are required to do annually and so are not much use to you) are transferable skills. Providing they are done by an accredited outside company, or were they done in house? As said they are of no use to them either way and are just being awkward.

The company may also have to keep certificates/ records of training after you have left.
This is incase you try to sue them for something and they can then show that you were properly trained to know the hazards/risks and how to deal with them.
