Hi,

I won three large upvc windows off the same seller on the weekend, he claimed he was away until wednesday this week, I got an email half an hour ago. Saying his shed had been broken into and the windows had been pinched, should i believe him?
I won them for a few quid, plus on his previous sales, his garden shed is listed as been sold

hmm, sounds dodgy to me. Has he got anything else for sale? use it as an excuse to go round and have a look. Too many people do this on ebay so you could always report him via paypal or to ebay

Yup, he has sold other upvc windows on the day i won mine, he sold his shed on the day i won mine. He has feedback for all of them too.

He also had around 10 upvc windows and doors still up for sale as well as other items!

Will ebay side with him, if he says they've been stolen?

I've had this before, and there is very little you can do. In theory you can buy new equivalents and then take him to small claims court to recoup the cost, but who would bother with the hassle? You could threaten him with this and see if he capitulates but you may find the windows get mysteriously damaged before you get them.

I don't think you've got much choice other than to leave scathing negative feedback.

You could persue him and possibly win but you would only get what you spent on the windows in compensation + costs. The question is, how highly do you value your time ?

If i don't get a crime number, i was thinking of reporting it with ebay and leaving it with them.
I already spent 5 days, watching and bidding on the items i won so I'm not wasting anymore time!

It is now common for sellers to save listing costs by not paying to have a reserve price and then making excuses when they don't get the price they want, if he still has them you can not force him to honour the sale, you can only report him to Ebay as a non performing seller and to do that you have to pay for the item with paypal and then await or claim your refund.

Any legal attempts through the courts etc would not really be worth the effort and result in you having to find proof etc etc

Actually I'm not surprised sellers resort to these tactics, ebay fee's are now very greedy. Traditional auctions don't charge reserve fee's, why should ebay. ?
When I want a minimum price for an item I use buy it now or best offer, although this does reduce the appeal of the item to buyers it saves me those b l o o d y fee's !

This story of his shed being broken into sounds very unlikely. Who's going to break into a shed to pinch window frames which are cumbersome to get away, of no scrap value and useless unless you know the sizes? You say he's sold the shed anyway. He might have had more than one shed.

He probably decided that the price wasn't worth the hassle or got a better offer locally.

There was a contract. You could try the law, but I don't think it's worth the trouble and might cost more than the frames are worth.

You could complain to ebay, but I doubt they'll want to do anything, and what could they do? Camcel his account?

It's just one to write off in my opinion.

He has replied that i can go to his to view all the paper work given to him by the police. So, end of really. Besides, like most of you are saying. I can't do anything anyway.

So, back on the hunt for windows again

wait until he cancels the sale and go along with that, then voice your concerns on his feedback, but be factual, like "seller claims items were stolen, but no crime number given", then forget about it, life's to short!

send him a message stating you cant get to pick them up as your car has been stolen.

childish but im with jay on this one. Keep an eye on his listings as he could be thick enough to re advertise them again

I sold something a few weeks ago.
I didnt put collection as an option as I dont like unknown people coming round and seeing what youve got etc.
The winner wanted to collect.I refused. Delivery charge was only a £5.

well he got really stroppy and tried threatening me....which is the worst thing to do to me.

So I just told him to F*** off and annoy someone else.

He paid including the delivery charge........I returned his payment

He started threatening again and reported me to ebay

So I reported him

Ebay agreed with me and refunded all the costs

It would be nice to 'feel better' but 2 non paying bidder strikes would see him unable to bid on every sellers items who has blocked non payers, this is now a large percentage of sellers who have activated this setting due to the time wasters on Ebay

non paying bidder strikes are only given if you don't respond to the dispute process - simple solution, respond when it's your turn to.

anyhow, lets take this childishness up another level

why not have a curry on friday night and then post him the contents of your bowels on saturday morning.

I have 2 ebay accounts and they are both set to block anyone who has had 2non paying strikes in 12 months.

After an item is sold you can look and see if anyone had been blocked during the bidding time, quite often this has been the case.

It does give you a little protection against timewasters but I have still had the one's where the cat has walked over the keyboard and bought my item or thier grandmother has died 'again' and they need the money for the funeral.

The best one was... Oh I don't want it! I am new and just wanted to see what happened when I won the bidding.
