Planning permission?

A question on planning permission, a nieghbour (2 doors away) put up this last year,

We normally cut the Buddleia back but that would allow view from platform into our patio doors.

As it is wooden I suppose it's a temporary structure, but can we do much about it from an invasion of privacy point of view?

It would require planning permission where I live because of it's height, I think but not sure the max allowed is 3 metres, I know my garage which required no planning permission over ground area came out ok because at it's highest point it is 2.8 metres.

If it's condsidered a temporary structure I don't think planning consent is required but a call to your local planning dept would confirm one way or another. They are quite helpful normally.

If you refute to planning portal there is loads of info about sheds etc. as it looks to have a balcony then defiantly needs planning

Looking at that pic, the 'ground floor' level appears to be an aviary or somesuch animal housing.

Is the upper storey strong enough to be used for adult 'occupation/leisure' pursuits? Looks like they extended upwards to give kids extra play room. In which case I can't really see kids spending much/any time 'spying on you?

I do understand your concerns, but have you considered having a quiet word to express your them to your neighbours?.

Unless you are paranoid and think they actually built it to spy on you I would not worry about it. Do they spend a lot of time in it looking in through your patio windows ? Just show them your @rse a couple of times they will soon get fed up. They probably built it that high to get some sun over the top of the massive conifer hedge, surely it would have been easier to cut their hedge a bit

As a matter of interest, how temporary is "temporary"? Is there a time limit after which you have to take it down or apply for PP?

I think "temporary" refers to the mode of construction. If it's made of brick it's a permanent structure. If it's made of prefabricated parts or wood it's different.

In this case I'd say the thing to do is to ask the local planning department and check. If this thiing required planning permission they might have applied for it and got it before putting it up.

I'd also be asking myself how much of an invasion of privacy this platform thing created and whether I really wanted to be involved with forcing a neighbour to take it down and the ill feeling arising. At least they are not next door neighbours.

According to all the articles I've come across, any 'raised platform' above 300mm from ground height requires planning permission so yes, they should have got permission before building it.
(Raised platform covers everything, even timber decking)

Do I Need Planning Permission?

Planning Permission may not be required subject to the following limits and conditions:

1. the decking is no more than 30cm above ground level
2. together with other extensions or outbuildings (such as sheds or garages), the decking or platforms cover no more than 50% of the garden area

If its classed as a climbing frame however that planning legislation does not apply if its under 4m and used for children's play activity's It can incorporate a platform and a ridge.

Not great idea going to the council if it used for said, will lead to alot of bad feeling, certainly would if it was me being shopped anyhow. properly better to talk to the neighbors direct if it does cause any problems.

Many years ago a neighbour had police call on then and told to cover up when sunbathing as they had received a complaint about being topless.
Never did find out who made the complaint.

We are assuming it was a lady sunbathing topless, if it was a bloke the complaint would have been justified I suppose.
