The distinction here is commercial vehicle. If you're towing a trailer with a commercial vehicle (ie van) then the wait of the trailer is taken as the plated weight of the trailer regardless of wether it is loaded or not. I have an L200 (max towing weight 2700 Kg) and a 3500Kg trailer - which I had plated at 2500Kg after checking with VOSA. If you're towing with a car then its the actual mass of the trailer that counts not its plated weight. A commecial vehicle is classed as such wether its being used for private use or hire / reward.
Double cab pick ups are a bit of a grey area I believe.
The tacho rules depend on wether the vehicle is used for hire or reward. Big horse boxes etc don't need a tacho if for personal use, but anything above 3500Kg for commercial use needs a tacho.
I have a class 1 (C+E) licence so checked all this with VOSA and a couple of mates who are CPC (transport managers) holders and its right. But it is late and I have just done a 17 hour shift (not driving !!!!) so any of the above could be wrong !
